No waste rock has been <br />mined since November 2008 with the exception of a minimal amount (less than 1 cubic <br />yard) resulting from maintenance activities in the mine (i.e. barring down loose rock). No <br />ore has been mined to date. The Whirlwind Mine was placed on "stand-by" due to current <br />economic conditions and the current depressed spot market price for uranium on <br />November 20, 2008. As described above, the mine went into intermittent status on May <br />12, 2009. During the period of stand-by, the mine has been maintained with twice per <br />week checks and dewatering. In addition, the water treatment plant has been kept in <br />operation to treat and discharge mine water. <br />Energy Fuels has remained diligent in meeting environmental compliance requirements set <br />forth in various permits and approvals required for the mine. A list of the various permits <br />and approvals and a brief summary of Energy Fuels' efforts to remain in compliance with <br />them follows. <br />Mesa County Conditional Use Permit <br />Bi-annual weed surveys and pesticide application were performed at the mine and <br />along 5110 Road and were reported to Mesa County and BLM. <br />Monthly monitoring of sediment pond posts (to detect ground subsidence) was <br />performed. No subsidence was detected. <br />Road maintenance was performed as needed including installation of culverts <br />(including delineator posts) and snow plowing. <br />DRMS Mine Permit <br />• DP and PR Springs were monitoring for flow and PR Springs and the mine sump <br />were sampled in accordance with the established schedule. The results were reported <br />quarterly to DRMS. <br />• Groundwater was monitored on a bi-monthly basis since October 2008 when <br />monitoring well W-1 was installed to establish baseline conditions.
