Please see the attached fee of $1,150.00 and the Annual Fee and Report <br />Request Form. Also attached is a map of the current site layout. The Whirlwind Mine is <br />currently operating in intermittent status. This was established with the Substitute for <br />Notice of Temporary Cessation, sent to your office on May 12, 2009 and approved with the <br />June 5, 2009 letter issued by DRMS. <br />Upon receiving the mine permit on September 10, 2008, Energy Fuels began construction <br />of the mine site in accordance with the permit application. The "Whirlwind Mine Portal <br />As-Built Site Report" was submitted to your office in January 2009 describing these <br />activities which included construction of the following items: <br />• Mine sediment pond <br />• Diversion ditches <br />• Collection ditches <br />• Culverts associated with all ditches <br />• Topsoil stockpiles from all site stripping <br />• Employee parking area <br />• Fill stockpile (from pond construction overburden) <br />• Septic system <br />• Phase I of the future waste embankment area (stripped of topsoil and prepared for <br />permanent waste storage) <br />Seeding was conducted to establish vegetation on the periphery areas of disturbance, the <br />fill and topsoil stockpiles, the diversion ditches, and the northeast portion of the waste <br />rock embankment expansion area. The vegetation has taken well in most of these areas. <br />In areas where the vegetation is sparse, re-seeding will be conducted in the late fall. <br />The following table summarizes the previous disturbance (permitted under Energy Fuels' <br />prospecting permits) and current disturbance.
