III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Complete Inspection of the Bowie No. 1 Mine conducted by Marcia Talvitie of the <br /> Colorado DRMS on August 19, 20 and 21, 2009. The inspection began at 1:30 p.m. on the 19th <br /> with a records check, at which time Basil Bear was notified of the inspection. The Loadout area <br /> was inspected later that afternoon. The West Mine and lower portion of the East Mine were <br /> inspected on the 20th; the East Mine was completed on the morning of the 215t. Weather <br /> conditions were clear, warm and breezy throughout the inspection. Basil joined the field <br /> inspection on the afternoon of August 20th. <br /> Steve Cragg, of Cragg Surveying, was working at the East Mine to place targets (Figure 1) in <br /> advance of an upcoming aerial survey of the reclaimed area. <br /> Availability of Records <br /> • Records were available for inspection at the BRL office located at the Bowie No. 2 Mine. A <br /> completed "DRMS Availability of Records" form is attached. <br /> • Permit documents for public viewing are to be made available at the Paonia Library. The <br /> Library has recently moved to a new building - located at 2 Third Street in Paonia. Coal <br /> permitting items received by the Library since the move occurred were stacked on a <br /> bookshelf. None of the envelopes had been opened. Older documents were not yet <br /> available for viewing; Library staff were not sure when organization of the new facility would <br /> be complete. <br /> Signs and Markers <br /> • Mine identification signs were posted at the entrances to the Loadout, East Mine and West <br /> Mine. <br /> • Permit boundary markers were observed around the East Mine perimeter. <br /> Roads <br /> • The gates at all three entrances to the Loadout Facility were open. Interior roads were dry. <br /> • The BLM road that accesses the West Mine was well maintained. The spur that leads from <br /> the corral to the upper side of the West Mine was dry and easily passable by vehicle. The <br /> gate at the permit boundary was fastened shut. <br /> • At the East Mine, the entire road has been narrowed to its final configuration. The surface <br /> was well graded and dry. <br /> • Nearly all of the equipment and temporary facilities used in reclamation of the East Mine <br /> had been removed. Equipment that remained: a motor grader, water truck, two <br /> articulated haul trucks and an excavator were parked along the haul road west of the West <br /> Ridge waste pile (Figure 2). <br /> Hydrologic Balance <br /> • At the Loadout facility, a diversion ditch flows around the southern perimeter of the upper <br /> bench. It appears that the outer berm of the ditch is being eroded at one location (Figure 3), <br /> and may be in need of repair. The Loadout Pond was dry and well vegetated. <br /> • The Highway Coal Stockpile pond was also dry, with numerous tumbleweeds in the bottom. <br /> These tumbleweeds should be cleared at least annually so that they do not obstruct the <br /> spillway. <br /> Bowie No. 1 Mine C-1981-038 19-21 Aug-2009 <br />
