HL COMMENTS-COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during the
inspection. Comments also describe any enforcement actions taken during the inspection and the facts or
evidence supporting the enforcement action.
Processing Waste
The temporary coal waste pile area located above the sediment was inspected. The clean water
diversion ditch around the waste pile and sediment storage area was stable (see comment below
regarding overgrowth of annual weeds). The berm around the waste pile was properly maintained.
Support Facilities
The shop and facilities areas were muddy but well kept. Perimeter areas at these locations were
maintained, and no problems were noted at the shop or facilities area during this inspection.
Revegetation
Growth of annual weeds (Kochia and Russian thistle)may need to be treated next year in the area
around the waste pile and particularly in the clean water diversion ditch around the waste pile. As seen
in the attached photograph, the weeds have nearly overtaken the diversion ditch. The annual weeds
may need to be chopped down or treated to evaluate the growth of the perennial cover crop that was
planted last spring when construction of the ditch was completed. In addition the area may need to be
reseeded. We will evaluate the annual weeds next spring to determine if further action is warranted.
}
Kochia and Russian thistle growing in and around the diversion ditch at the waste pile.
