M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection of the McClane Canyon Mine conducted by Mike Boulay of the <br /> Division of Reclamation, Mining and Safety on August 26, 2009. Rodney Head the Safety Director <br /> for McClane Canyon Mining LLC (MCM) was present during the entire inspection. Weather <br /> conditions were sunny and warm. Ground conditions were dry. Coal was being conveyed and hauled <br /> from the mine at the time of the inspection. <br /> Availability of Records <br /> The availability of records was checked at the mine office on the morning of August 26`h. Several <br /> required items were not available for review in the records file at the mine office. These are noted on <br /> the attached records checklist at the end of this inspection report and described below. The 2009 <br /> Midterm Review Document(MT-6) has not been added into the records file. With MT-6 the Division <br /> updated the reclamation cost estimate and found that the new liability for the McClane Canyon Mine is <br /> $367,256.00. This amount is $47,976.000 more than the current bond held (of$319, 280.00). MCM <br /> will need to submit a minimum of$47,976.00 in additional bond monies and update the bond <br /> document in the records file accordingly. Also the Insurance Certificate in the records file has expired <br /> on 06/09 and a current certificate needs to be added to the files. The NPDES Permit expired on <br /> 8/31/09. MCM has applied for renewal of the referenced discharge permit with the Colorado <br /> Department of Public Health& Environment. The renewal request letter dated February 9, 2009 <br /> should be added to the records file for documentation. Please update the mine site records with these <br /> documents. All other required records were on file and available for review. <br /> Roads <br /> Roads were maintained and in good condition throughout the site. Ditches along the haul road were <br /> dry and appeared to have been recently cleaned by removing sediment and debris. Culverts were <br /> properly maintained and functional. MCM was watering roads for dust suppression. <br /> Hydrologic Balance <br /> Drainage structures and diversion culverts in the portal area were dry and clear of debris. The <br /> perimeter ditch behind the shop area was dry and well maintained. The mine was not discharging <br /> water. The sediment was inspected and no problems were identified. The water level in the pond was <br /> a couple of feet below the principal spillway. <br />
