4.) According to the mining plan, a visual screening berm will be constructed along Brighton <br />Road. Please describe the dimensions of this berm and display it on the Mining Plan map. <br />Exhibit E <br />5.) In regard to Item #13, you state that "topsoil will be used as needed in the reclamation of <br />perimeter slopes and on associated upland areas that are to be revegetated". Please explain <br />your statement that topsoil will be replaced "as needed". Given your response for Item #14, <br />that Cell No. 2 will be backfilled so no open water will remain, the entire site will need to be <br />topsoiled and revegetated. <br />6.) In regards to item #15, you provided two seed mixtures to be used, one for the "Upland <br />Areas" and one for "Saturated Areas". In the attachments with your adequacy review <br />response, there were also two seed mixtures given. One was for "Upland Areas", which <br />matches the seed mixture given in item 15, however the other was titled "Seed Mix for Ponds <br />and Wetland" and it differs from the "Saturated Areas" seed mix given in item #15. It is unclear <br />which seed mixtures will be used. Please identify which seed mixtures will be used. For <br />financial warranty purposes and clarity, on the reclamation plan map please highlight the areas <br />where each of the seed mixtures will be used. <br />7.) For item #17, please commit to submitting the inert fill signed affidavit and obtaining the <br />Divisions approval prior to importing any backfill material into the permit area. <br />Exhibit F <br />8.) In regard to Item #19, the proposed final land use for Cell No. 2 and the expansion area is <br />not labeled on the reclamation plan map. According to the reclamation plan, the proposed land <br />use for Cell No. 2 should be wildlife habitat. Originally, the proposed land use for the expansion <br />area was cropland and pasture, but it appears this has changed to wildlife habitat. Please label <br />the Reclamation Plan Map accordingly. <br />9.) The Reclamation Plan map indicates that Phase 18 will be used for water storage instead of <br />an open water lake. Is the new plan to install a slurry wall around Phase 18? Please explain this <br />discrepancy? If Phase 18 will remain an open water lake, please update the reclamation plan <br />map to display with land use instead of water storage. <br />10.) The topography of the Cell No. 2 area is not portrayed too much different than the pre- <br />mining plan maps of this area. The topographic lines are poorly labeled and hard to read, but <br />the pit slopes appear to remain steep surrounding the "wetlands" and "backfilled" areas. Also, <br />either large mounds or depressions are indicated to be left in place surrounding the "backfilled" <br />area and "wetlands". Given the post mine land use for this area, these contour lines do not <br />coincide with the reclamation plan. In accordance with Rule 6.4.6 the reclamation plan map <br />must indicate the expected physical appearance of the affected land, and the map must show <br />the proposed topography of the area with contour lines of sufficient detail to portray the
