Rimrock Exploration & Development, Inc. <br />J-Bird Uranium Mine/ DMO/ EPP Other Agencies' EPP Measures <br />2.04.13, an Annual Reclamation Report is due to DRMS by February 15th of each year. <br />Changes to the mining and reclamation operations may require modifications and <br />technical revisions. <br />3.2.2 The Colorado Department of Public Health and Environment (CDPHE) <br />The Colorado Discharge Permit System (CDPS) General Permit for stormwater <br />discharges associated with metal mining operations was issued by the Water Quality <br />Control Division (WQCD). A copy of the General Permit Application and Certification <br />Authorizing Discharge (CAD) is provided in Attachment E. This CAD requires a <br />complete Stormwater Management Plan (SWMP) for this facility to be prepared <br />according to the General Permit requirements. A Stormwater Annual Report is due to <br />CDPHE on February 15th of each year. Twice a year, any off-site discharges which meet <br />event criteria and have contacted on-site disturbances require samples to be collected at <br />pre-determined discharge points. These samples are to be analyzed and reported as <br />detailed in the CAD. <br />The previous operator, B1ueRock Energy Corp., (BREC) submitted and received <br />approval from the Colorado Air Pollution Control Division (APCD) for an Air Pollution <br />Emission Notice (APEN). The APEN quantifies potential air pollutants from fugitive <br />dust and generator emissions. These two sources are considered to be minor sources by <br />the APCD. Changes in the production rate or immobile internal combustion motors <br />(generators) at the Mine will result in a revision of the APEN. Currently, there are no <br />activities at the J-Bird Mine, therefore, the APEN is inactive. <br />3.2.3 State of Utah, School and Institutional Trust Lands Administration (SITLA) <br />No Easement Permit is in place from SITLA to allow Rimrock to use and, if necessary, <br />improve road segments. Under the previous operator, SITLA determined a Right of <br />Entry Permit was not needed as the Easement Permit covered road-use and improvements <br />appropriately. <br />3.3 LOCAL AGENCIES <br />Right of Way Permit and Access Permits are in-place with Montrose County, Colorado. <br />These permits allow for minor road improvements and access from the County Road to <br />the Mine. Similar conditions of road use and maintenance requirements are detailed in <br />the BLM conditions of approval. San Juan County, Utah, applied for and received from <br />the BLM Moab Field Office, a Right of Way authorization under Title V of the Federal <br />Land Policy and Management Act (FLPMA) of a previously existing R.S 2477 road. <br />6
