Rimrock Exploration & Development, Inc. <br />J-Bird Uranium Mine/ DMO/ EPP Other Agencies' EPP Measures <br />3.0 OTHER AGENCIES' EPP MEASURES <br />3.1 FEDERAL AGENCIES <br />The entire project is situated on public land managed by the United States Department of <br />Interior, Bureau of Land Management (BLM). The Uncompahgre Field Office (UFO) <br />out of Montrose, Colorado is the local office. Under the National Environmental Policy <br />Act (NEPA) an Environmental Assessment (EA) was completed by the BLM - UFO in <br />November, 2006. A Plan of Operations (PO) with conditions was approved by the BLM- <br />UFO in April, 2007. A summary of the EA, PO, and EPP measures follow. These <br />conditions are included in the EPP by reference and greater detail is available within the <br />EA: <br />• Air Quality (AQ): The project area will be seeded with a BLM approved seed <br />mix to stabilize soils and reduce impacts of dust created from wind erosion. If <br />dust becomes visible, the operator will be required to provide dust abatement <br />measures to the road and location. <br />• Cultural Resources (CR): If subsurface cultural resources are unearthed during <br />operations, activity in the vicinity of the cultural resource will cease and a BLM <br />representative notified immediately. The operator is responsible for informing all <br />persons associated with this project they will be subject to prosecution for <br />knowingly disturbing or collecting cultural resource artifacts of any kind. <br />• Invasive, Non-Native Species (INNS): The operator is required to control weeds <br />for the life of the PO in accordance with Montrose County weed regulations. <br />• Threatened, Endangered and Sensitive Species (TESS): If water depletions <br />associated with mining activities exceed 0.2 acre feet/ year, BLM will be notified. <br />If additional effects on species listed under the Endangered Species Act (ESA), <br />consultation with U.S Fish and Wildlife Service will be reopened. If the mine is <br />inactive for more than one year, the portal shall be closed in a manner sufficient to <br />prevent colonization by bats. <br />• Wastes/ Hazardous or Solid: Signs will be posted on-site that identifies <br />potential hazards associated with this operation, including chemical hazards. The <br />mine site will be designed as not to allow off-site runoff water to enter the pad. <br />Material Safety Data Sheets (MSDS) for any chemicals will be maintained on <br />site. Sanitary facilities will be required on location. Any fuel spills will be <br />immediately reported to the authorizing officer. <br />4
