La Salle Pit <br />M-2009-042 <br />Preliminary Adequacy Work Sheet <br />Rule 1.6.1 Public Notice <br />Office sent out required notices on June 17, 2009. <br />Rule 1.6.2 <br />a) Notices to County Commissioners, Soil Conservation: certified mail or date <br />stamp- appears adequate <br />b) Proof of notice posting at site- copy in file <br />c) County Clerk Copy- date stamped <br />d) Notice Publication: Name and address, location, proposed dates, future use, <br />location for additional info and final date for submission of comments. 4 <br />consecutive weeks and 20 days after last date. <br />1.6.2(d)(vi) requires location and final date for submitting statements to the <br />office. Proof of notice is lacking that info. Require republication with required <br />comment date. <br />e) Notice to owners of record of the surface and mineral of affected area and <br />landowners within 200 feet of "affected" lands. <br />DRMS has copies of mail receipts but not signature returns -please provide <br />f) Any other notices needed- Appears to have been addressed. <br />g) Proof of Publication and notices- see d and e <br />Rule 6.2.1(2)(b) all maps must be signed by a registered land surveyor, professional <br />engineer, or other qualified person, give date prepared and identify and outline the area <br />which corresponds with'the application. Maps meet rule standards. <br />Rule 6.4, Specific requirements for a 112 Reclamation Operation: <br />6.4.1 - Exhibit A, Legal Description, Appears Adequate <br />6.4.2 - Exhibit B, Index Map, Appears Adequate <br />6.4.3 - Exhibit C, Pre-Mining and Mining Maps. Adjacent landowners clearly ID'd <br />(a) Adjacent landowners: Excel Realty and Nations are not clearly identified. <br />(b), Appear adequate <br />(c), Appear adequate <br />(d) Please clearly define permit and affected area boundaries on all maps. <br />Current maps show only permit boundaries. If all inclusive please note <br />accordingly. <br />(e) Noted in Exhibit J <br />(f) Noted in Exhibit G, and on C maps, appears adequate <br />(g) Noted in Exhibit S and on C map, appears adequate <br />(h), Noted in Exhibit I
