Technical Revisions <br />TR-48, approved October 14, 2003, incorporated information regarding 12" and 26" HDPE <br />pipelines that were installed across the permit area for conveyance of West Lateral Ditch <br />irrigation water to downstream users. This revision also modified the approved surface water <br />monitoring plan <br />TR-49 was approved on December 15, 2003. It revised the post=mining land use from Irrigated <br />Pasture to Dryland Pasture on 28.99 acres known as the James Martin property. <br />TR-50, approved on December 16, 2003, changed land use and reclamation topography, at <br />landowner request, to optimize farmable ground. <br />rV" L-1 <br />111-51, approved or August 27, 2004, desiguatteu a pre-iriiniiig topographic uepressiun as <br />sediment control pond 014. <br />TR-52 approved the design of sediment control Pond 012 and was approved on January 18, <br />2005. <br />TR-53 was approved on September 16, 2005, establishing an area at the Nucla airport to be the <br />reference area for Dryland Pasture. <br />The Midterm Permit Review No. 5 (MT-5) was submitted to WFC on November 23, 2005. <br />With MT-5 the Division had a significant number of adequacy questions. Key adequacy <br />concerns included performance bond requirements and the lack of sufficient detail in the current <br />Permit Application Package (PAP) to recalculate the bond liability estimate for the midterm <br />review. Other sections of the PAP that needed to be updated were the hydrologic balance <br />documentation, including probable hydrologic consequences; drainage and sediment control; and <br />groundwater monitoring. The Division requested that WFC submit a technical revision <br />addressing these adequacy concerns by January 31, 2006. WFC prepared Technical Revision No. <br />54 (TR-54) to address the Midterm Review comments, which was received by the Division on <br />April 10, 2006. TR-54 was approved on July 30, 2007 and the existing permit document was <br />substantially updated to include seven volumes of permit application materials. The PAP now <br />combines New Horizon Mine 1 site information with New Horizon Mine 2 into one permit <br />document. <br />At the time of the MT-5 submittal to WFC in November 2005, the Division was still in the <br />process of reviewing the revegetation plan information contained in the PAP. The Division <br />forwarded an Addendum to the Midterm Review to WFC with revegetation plan comments on <br />December 27, 2005. The revegetation plan changes were finalized subsequent to the completion <br />of the Midterm Review and TR-54 approval. <br />TR-55 was submitted by WFC on November 17, 2007. The revision would have incorporated a <br />new irrigated pasture reference area, but also included various other proposed changes to the <br />revegetation and postmining land use plan that generated substantial concern and comment from <br />5
