Technical Revisions
TR-48, approved October 14, 2003, incorporated information regarding 12" and 26" HDPE
pipelines that were installed across the permit area for conveyance of West Lateral Ditch
irrigation water to downstream users. This revision also modified the approved surface water
monitoring plan
TR-49 was approved on December 15, 2003. It revised the post=mining land use from Irrigated
Pasture to Dryland Pasture on 28.99 acres known as the James Martin property.
TR-50, approved on December 16, 2003, changed land use and reclamation topography, at
landowner request, to optimize farmable ground.
rV" L-1
111-51, approved or August 27, 2004, desiguatteu a pre-iriiniiig topographic uepressiun as
sediment control pond 014.
TR-52 approved the design of sediment control Pond 012 and was approved on January 18,
2005.
TR-53 was approved on September 16, 2005, establishing an area at the Nucla airport to be the
reference area for Dryland Pasture.
The Midterm Permit Review No. 5 (MT-5) was submitted to WFC on November 23, 2005.
With MT-5 the Division had a significant number of adequacy questions. Key adequacy
concerns included performance bond requirements and the lack of sufficient detail in the current
Permit Application Package (PAP) to recalculate the bond liability estimate for the midterm
review. Other sections of the PAP that needed to be updated were the hydrologic balance
documentation, including probable hydrologic consequences; drainage and sediment control; and
groundwater monitoring. The Division requested that WFC submit a technical revision
addressing these adequacy concerns by January 31, 2006. WFC prepared Technical Revision No.
54 (TR-54) to address the Midterm Review comments, which was received by the Division on
April 10, 2006. TR-54 was approved on July 30, 2007 and the existing permit document was
substantially updated to include seven volumes of permit application materials. The PAP now
combines New Horizon Mine 1 site information with New Horizon Mine 2 into one permit
document.
At the time of the MT-5 submittal to WFC in November 2005, the Division was still in the
process of reviewing the revegetation plan information contained in the PAP. The Division
forwarded an Addendum to the Midterm Review to WFC with revegetation plan comments on
December 27, 2005. The revegetation plan changes were finalized subsequent to the completion
of the Midterm Review and TR-54 approval.
TR-55 was submitted by WFC on November 17, 2007. The revision would have incorporated a
new irrigated pasture reference area, but also included various other proposed changes to the
revegetation and postmining land use plan that generated substantial concern and comment from
5
