pre-mining grade elevations and the operator shall shut <br />down all mining and processing activities when the wind <br />speed reaches an average wind speed of 35 miles per hour <br />over a ten minute period. The operator may continue to <br />load and haul sand and gravel from existing stockpiles to <br />off-site locations. <br />12. Hauling equipment shall be cleaned of loose materials to <br />prevent spilling on the highways. <br />13. The operator shall conform to all current Federal, State <br />and County blasting regulations. All blasting shall be <br />conducted in a manner which will not cause a peak particle <br />velocity on any adjacent or nearby property which exceeds <br />one-half inch per second. All mining and associated <br />activities and uses must meet State of Colorado and Federal <br />regulations regarding noise pollution. The operation shall <br />be conducted so that any noise produced is not <br />objectionable due to intensity, intermittence, beat and <br />rhythm, frequency, or shrillness to the surrounding area. <br />14. The operator shall prevent sediment from entering the <br />Church or McKay Ditch and keep all pollutants from the <br />mining operation from entering local drainages. The <br />applicant shall provide a copy of the agreement with the <br />City of Broomfield concerning the McKay and Church Ditch <br />prior to the First Annual review. <br />15. The operator shall stockpile overburden for later use in <br />the reclamation efforts. <br />16. The operator shall destroy the smallest possible amount of <br />wildlife habitat during the life of the mine operation and <br />shall carry out the reclamation plan with the intent of <br />encouraging the re-establishment of the wildlife community. <br />17. The main access to the site shall be the haul road approved <br />in Board of Adjustment Case No. M79-1-A-1 directly off <br />Highway 93 and shown on the application. If any change in <br />access is to occur, the applicant shall advise the Board of <br />Adjustment through its Executive Secretary prior to the <br />actual relocating of the access road. <br />18.
