<br />operation will not hinder the patrolling of the perimeter <br />of the D.O.E.'s property by the D.O.E.'s security patrols. <br />8. That the applicant agrees to enter into an agreement with <br />the City of Broomfield prior to the start-up of pre-development <br />work on this site, resolving all problems concerning Church <br />Ditch and McKay Ditch and the potential loss of water, <br />interruption of flow, quality, damage to the Ditch, and future <br />improvements to the Ditch. <br />9. That water will be needed in the sand and gravel <br />operation to comply with the State Air Pollution Standards. <br />The applicant will obtain a proper State Fugitive Dust <br />Emissions Notice prior to pre-development mining <br />activities. <br />10. That due to the increase in truck hauling there is a <br />necessity to control the hours of operation relating to <br />truck traffic and operation. <br />11. That certain conditions and restrictions are necessary <br />to protect the surrounding land uses. <br />12. That the applicant has provided a study verifying that <br />the levels of radiation on site are safe and below all <br />Federal and State standards. <br />13. That it is in the interest of the health, safety and <br />welfare of the citizens of Jefferson County that the Board <br />of Adjustment grant the applicant the special exception for <br />a temporary use of land for purpose of excavating and <br />removing sand, gravel, and possibly clay in a <br />Mineral-Conservation (M-C) Zone District for the life of <br />the mine as defined by Section 34-32-103, C.R.S. <br />NOW, THEREFORE, BE IT RESOLVED that pursuant to the powers <br />vested in it by Section 13-D-5 of the Jefferson County Zoning <br />Resolution the Board of Adjustment hereby grants and approves a <br />special exception to mine sand, gravel, and possibly clay in a <br />Mineral-Conservation (M-C) Zone District for the life of the <br />mine operation subject to the following conditions and <br />restrictions, each and every one of which shall be strictly <br />complied with: <br />3
