(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-2001-085 <br />INSPECTION DATE: 18 Augtist 2009 INSPECTOR'S INITIALS: _DR? <br />OBSERVATIONS <br />This inspection was conducted by David Bird and Tony Waldron of DRMS. The site is located in Adams County <br />about 6 miles south of Brighton near the intersection of Brighton Road and East 1201" Avenue. The commodities <br />mined are sand and gravel. The total permit area and disturbed area are both listed as 49.1 acres. The Division <br />holds a bond in the amount of $435,500 for the operation. The post-mining land use for this site is described as <br />developed water resource. Les Ewegen and Dave Schultejann were present representing the Operator. <br />The site is of concern to the Division because of the reported failures of the slurry wall that was installed in 2004. <br />The failure of the slurry wall has forced the operator to increase dewatering pumping from the pit to allow dry <br />mining. The mine's Substitute Water. Supply Plan allows disposal of the pumped water to either the South Platte <br />River, by way of the City of Brighton's 124'h Avenue pipeline, or to the Henderson Water Ski Club Lake (HWSCL) <br />to the immediate north. Because the source of water pumped from the pit is shallow alluvial ground water, and <br />the two receiving sites to which the water is pumped essentially return the water back to the shallow alluvial <br />ground water system, the cycle does not represent a net depletion of surface water or ground water and the plan is <br />allowed. However, the increased pumping to the HWSCL, an unlined facility, has the potential to increase the <br />flow of ground water to the Zigan Lake, an unlined facility located across 124" Avenue to the north of the <br />HWSCL. The Division has already received numerous complaints from the Zigan Homeowners Association <br />(starting 15 May 2009) regarding rising water levels in their lake that they attribute to mining in the area. <br />The operator has limited confidence that repairs to the slurry wall will bring it into compliance with design <br />specifications. Therefore they propose to amend their reclamation plan to include installation of a clay liner in the <br />pit. The operator will mine down to the clay layer in the pit, and then use the clay layer as a source of material for <br />the liner. The operator believes that they can have the overlying material completely removed by the end of <br />calendar year 2009. The Division will be in communication with the operator in the coming weeks on how to <br />proceed. <br />Because of the potential adverse effects on the prevailing hydrologic balance, the ground water containment issue <br />is cited as a problem on page 3 of this report. The operator will be given 60 days to submit an Amendment to <br />Reclamation Plan, and 90 days from the date of approval of the plan amendment to install the clay liner. <br />Additionally, the Division has been made aware that the Operator has lapsed on renewal of their Substitute Water <br />Supply Plan.
