Ms. Jennifer Lindahl
August 10, 2009
Page 2

The pit is located greater than 100 feet from the Big Thompson River and the resulting
depletions have been lagged to account for the delayed effects on the river system. The IDS
AWAS stream depletion model was used to determine the lagged depletions to the Big
Thompson River.. The following parameters were used in the model: transmissivity (T) = 225,095
gallons per day per foot, specific yield (SY) = 0.2, the distance from the Big Thompson River to
the edge of the alluvium = 2,290 feet, and the distance from the centroid of the exposed surface
water areas to the Big Thompson River is approximately 720 feet. Lagging of both depletions and
accretions have been accounted for at the gravel pit and the settling pond, respectively.
Replacements
The operator proposes to provide replacement water for the actual operational depletions
from a portion of a 200 acre-foot lease agreement with the City of Loveland. This 25-year lease
was originated in January 1998 and extends through December 31, 2022. The fully consumable
water that is offered by the City of Loveland includes, but is not limited to, native water from the
Big Thompson River basin as stored within the City's reservoir system, Windy Gap Water, or any
water subsequently acquired by the City. A transit loss of 1.8% will be charged for the delivery of
this water to the subject site. This agreement with the City extends beyond the approval period
of this SWSP. The monthly evaporative and operational losses and proposed monthly
replacement requirements for the approved year of depletions at this gravel pit can be found on
the attached Tables 2, 4 and 5. The City of Loveland lease is also used for the Green/Croissant
Pit and Baer Pit.
I hereby approve the proposed substitute water supply plan in accordance with C.R.S. §
37-90-137(11), subject to the following conditions:
Conditions of Approval
1. This substitute water supply plan shall be valid for the period of September 1, 2009 through
August 31, 2010, unless otherwise revoked, modified, or superseded by decree. If this plan will
not be made absolute by a water court action by the plan's expiration date, a renewal request
must be submitted to this office with the statutory fee (currently $257) no later than July 16,
2010.
2. Well permit no. 66399-F was obtained for the current use and exposed pond surface area of
the gravel pit pond in accordance with §37-90-137(2) and (11), C.R.S.
3. The total surface area of the groundwater exposed at the Bokelman/Walters Pit must not exceed
0.16 acres resulting in a maximum annual evaporative loss of 0.37 acre-feet.
4. The annual total product mined at the Bokelman/Walters Pit shall not exceed 200,000 tons per
year resulting in 5.89 acre-feet of water lost with the mined aggregate.
5. Total consumption at the Bokelman/Walters Pit must not exceed these aforementioned amounts
unless an amendment is made to this plan.
6. The existing lease of the replacement water is evidenced by an agreement with the City of
Loveland dated January 13, 1998. A copy of the lease agreement was furnished to this office
with this plan request. All replacement water must be concurrent with depletions in quantity,
timing and location.
7. Approval of this plan is for the purposes as stated herein. This office must first approve any
additional uses for which the water may be used. Any future plan that allows credit for historical
