E. <br />State Engineer <br />r CFPV - <br />iAUG 18 2009 <br />Divislori oT rWC:W ilat*rP , <br />Mining and Safety <br />We have received your letter of July 9, 2009, requesting renewal of the above referenced <br />substitute water supply plan ("SWSP") to cover depletions caused by a gravel mining operation. <br />The required fee of $257.00 for the renewal of this SWSP has been submitted (receipt no. <br />3641589). The original supply plan was approved on September 11, 2007. <br />Plan Operations <br />This plan seeks to replace depletions resulting from the mining at the Bokelman/Walters <br />Pit. The depletions that result from the mining operation include evaporation and water lost in <br />the mined product. The proposed replacement source is a contract with the City of Loveland for <br />fully consumable water. The Bokelman/Walter Pit is located in Section 24, Township 5 North, <br />Range 68 West of the. 6th P.M. just southwest of the Big Thompson River and will be mined in <br />two phases. Phase I consists of four cells on the western portion of the property. Phase ll <br />consists of three cells to be located on the eastern portion of the property. Cell 1 within Phase I <br />was proposed to.be completed by 2009, however due to economic conditions Loveland Ready <br />Mixed ("LMR") will continue to mine this cell for approximately the next three years. Cell 1 will <br />continue to be dewatered and this water will be pumped to a settling pond where it will be allowed <br />to recharge the aquifer or be pumped back to the Big Thompson River. <br />Depletions <br />This plan describes the maximum proposed water uses from September 1, 2009 through <br />August 31, 2010 for this pit. The SWSP anticipates a maximum depletion of 6.26 acre-feet for <br />an exposed groundwater surface area of 0.16 acres. You have provided a monthly breakdown of <br />the maximum annual depletions totaling 0.37 acre-feet of evaporative loss from a maximum of <br />0.16 acres of exposed groundwater at a settling pond and 5.89 acre-feet of water losses <br />associated with the extraction of an estimated 200,000 tons of aggregate from below the water <br />table. Dust suppression on the site will be met by water imported from another location.
