EXHIBIT H <br />WILDLIFE STATEMENT. <br />Attached is a letter from Mr. Lyle H. Sidener the Area <br />Wildlife Manager for the Colorado Division of Wildlife dated <br />April 27, 2009. We wish to thank Mr. Sidener for the time he <br />took to review our project. <br />The report indicates that sage grouse use the mine property <br />as an alternate lek site and is year around habitat. The county <br />understands the Divisions concerns. We realize that as the mine <br />is opened the sage grouse may begin to use the site more and have <br />concerns that this will have an impact on our mining operations. <br />Grand County has accommodated the grouse at other pits in this <br />area and feel the grouse will adapt to mining and year around <br />activities at this site. This site is surrounded by may 100's of <br />acres of suitable grouse habitat that they can used if this site <br />is not available. Grand County Department of Road and Bridge's <br />Mission Statement "is to provide safe, well maintained county <br />roads in all weather conditions" and it can not succeed if the <br />mine is closed in the spring to accommodate the grouse. Grand <br />County has committed to building the perimeter fencing to DOW <br />specifications to accommodate the wildlife that use and migrate <br />across the property. <br />20
