<br />Exhibit N (page 2) . A! IAl:ANIPN I A <br />SPECIAL STIPULATIONS <br />MOFFAT COUNTY FREE USE PERMIT # COC 073643 <br />Cop CLAY PIT #21 <br />T.9N. R.96 W. <br />SEC. 10: N/2 <br />During the initial pit development, no surface disturbing activities are permitted between May 15 and <br />August 15 to protect nesting Brewer's sparrow and sage sparrow. <br />2. Pit rehabilitation shall consist of the following requirements: <br />a) All rejected material will be buried in the excavation prior to rehabilitation. <br />b) The pit wall shall be sloped to blend with surrounding existing contours, not to exceed 3H:1 V <br />c) The pit segment floor and access routes are to be disked or ripped to loosen compacted soils. <br />d) Stockpiled topsoil shall be spread evenly over the sides and bottom of the pit segment <br />excavation. <br />3. Any cultural and/or paleontological resource (historic or prehistoric site or object) discovered by the <br />holder, or any person working on his behalf, on public or Federal land shall be immediately reported to the <br />authorized officer. Holder shall suspend all operations in the immediate area of such discovery until <br />written authorization to proceed is issued by the authorized officer. An evaluation of the discovery will be <br />made by the authorized officer to determine appropriate actions to prevent the loss of significant cultural or <br />scientific values. The holder will be responsible for the cost of evaluation and any decision as to proper <br />mitigation measures will be made by the authorized officer after consulting with the holder. <br />In the area of the terrace edges and in the areas of 5MF4424 there will be no blading below the six inches <br />of pit-run base course and two inches of road base, a total of 8 inches. If any road surface repair is needed <br />in these areas it will limited to placing more road base in these areas. This is to protect the known site and <br />any buried sites found in these areas. <br />The county will be responsible to see that the road in these areas is maintained in such a manner that the <br />protective surface is in place during the operation of the pit. The county will be responsible for mitigation <br />of the cultural sites, 5MF4424 and any buried site(s) that may be impacted as a result of road damage that <br />exposes cultural materials below the 8 inches described in the October 22, 1998 letter. Once the pit is <br />closed and fully reclaimed, this stipulation will no longer apply to the County. <br />4. Pursuant to 43 CFR 10.4(g) the holder of this authorization must notify the authorized officer, by <br />telephone, with written confirmation, immediately upon the discovery of human remains, funerary items, <br />sacred objects, or objects of cultural patrimony. Further,. pursuant to 43 CFR 10.4(c) and (d), you must <br />stop activities in the vicinity of the discovery and protect it for 30 days or until notified to proceed by the <br />authorized officer. <br />4. No hazardous materials/hazardous wastes, trash or other solid waste shall be disposed of on public lands. <br />If a release does occur, it shall be reported to this office immediately. Permittee is responsible for disposing <br />of all debris in accordance with state and federal regulations. <br />Exhibit N (p11?&?e 2)
