Rule 6.4.14 Exhibit N - Source of Legal Right to Enter <br />4. The letter dated July 15, 2009 from Ed Camilletti authorizing Precision Excavating to mine gravel was not <br />notarized and the location, NE1/4NW1/4 section 22, is not consistent with the legal description indicated on <br />the application form or Exhibit A. Per Rule 6.3.7, please provide a description of the basis for legal right of <br />entry to the site and to conduct reclamation, for the Owners of Record described in <br />Subparagraph 1.6.2(1)(e)(i). This may be a copy of access lease, deed, abstract of title, or a current tax receipt. <br />A signed statement by the Landowner and acknowledged by a Notary Public stating that the <br />Operator/Applicant has legal right to enter and mine is also acceptable. Please provide the Division with a <br />signed and notarized statement from the Landowner with a correct legal description. <br />Please be advised that the Camilletti Milner Pit #2 amendment application may be deemed inadequate, and the <br />application may be denied on August 14, 2009 unless the above mentioned adequacy revie.v items are <br />addressed to the satisfaction of the Division. If you feel more time is needed to complete your reply, the Division <br />can grant an extension to the decision date. This will be done upon receipt of a written waiver of your right to a <br />decision by August 14, 2009 and request for additional time.
