(e)'Widdlife. <br />(f) Access„ and (g) Mina and Reclamation Plans arc attached to and <br />made a part of sodium preference right lease 00120057. These <br />stipulations are also imposed upon lessee's employees and agents. <br />The h9uae or ref mal of any of these persons to comply with these <br />stipulations shall be deemed a failure of the lessee to comply with the <br />terms of the lease, Lessee shalt rcquitt its agents. contractors. and <br />subcontractors involved in activities on this lease to include these <br />stipuulatiotu in the contracts between and among them. The special <br />stipulations may be n N ised or amended. in writing, by mutual consent <br />of the lessor and the lessee. <br />(a) Cultural $ fig, Lessee shall undertake measures in acr.or- <br />dance with instruct ens from the authorized officer to protect cultural <br />resawrces on the leased lands. The lessee shall not (oaten( any <br />swfacedisnabi ngacdvidestattlepamissiom topmcadisgivemby the <br />authorized officer. For this (Mensal resources stipulation, the autho• <br />rued officer of the BLM will be the Craig District Managa. <br />(1) Before tmaehalonganyactivities that may disturb the surface of <br />the leased lands, lessor: shall conduct a cultural resource Class III <br />inventory on those lands thathave trot bem p mvitrusly invenwmd and <br />that: may be affected by lease-relasedaaivitics. The inventory shall be <br />totrducted by aqualifued professional culiural «:m= specialist (i.e.. <br />archaeologic, historian, or historical architect. as appropriate) ap- <br />pmved by the attdwdztd oar of the BLM and in the mar mar <br />specified by the authorized officer. Lessor shalt submit a report of me <br />inventory and recommendations for protecting any identified cultural <br />resources to the authorized officer. <br />(2) Less= shall proem all bx wn cultural resource pROperties <br />within the lease area from lease-related activities until the cultural <br />r?esowee mitigation measures can be implemented as part of an <br />app-- explorations plan or an approved mining plan, <br />(3) The cast of conducting the inventory. pawing reports, and <br />carrying out mitigation measrra shall be borne by the lessee. <br />(4) Ifcultural resources am discovered during operatim under this <br />tease. the lei shall i n nediately bring them to the atsentioe of the <br />authorized officer, The lessee shall not disturb such riesouroccs except <br />as subsequently authorizcdby the BLM. Within five (5) working days <br />of notification, the authorized officer will evaluate or have evaluated <br />any cultural resources discovered and will determine if any aeon may <br />be required to protect or to preserve such discoveries The cost of dais <br />recovery for culturw resources discovered during lease operations <br />shall be borne by the lessor. <br />(b) EdGMtolgjjW Resources. (1) Before undertaking any activities <br />that may disturb the surface of the leased lands, lessx slant employ a <br />qualified professional paleontologist to map the extant of the Class I <br />and It geologic formations. The paleontological appraisal shall be <br />conducted as directed by the authorized officer who may acquire a <br />field surrey of all outcrops within identified Class I ant! If the archaeol <br />detamimes that a human association exists, the specimen seta <br />handled as a cuilpaal resource under Sec. 15(a) as directed b- <br />authorized officer. <br />(c) .(1) Beforeunde <br />ing any acdvkics that may disturb the. surface of the leased I <br />lessee shall have a qualified professional conduct an intensive <br />inventory for threatened, endangered. sensitive, and rage plants i <br />manner spedfied by the authorized oW= on those portions c <br />exploration area, atone plate arm or adjacent arras that wen <br />previously invectinried to such a level of intensity and which ma <br />Mversely affected by lease-related activities. <br />(2) The inventory shall be conducted by a qualified profess <br />approved by the authmized officer. A report of the inventory <br />rcCOtntmendadons for the protection of any species identified she <br />submitted to the authorized officer. The lessee shall not comm <br />any surface disaubing activities until the authorized officer <br />reviewed the report. determined whether mitigation is required <br />given approval to proceed. <br />(d) Scientific Study Site. To protect a Colorado State Uniive <br />scientific study site. no surface occupancy shall be permitted w <br />the following described area: <br />T. 2 S..
