13. In order to preclude any potential disturbance to nesting purple martins in areas where <br />exploration activities would affect mature aspen stands, nest site surveys would be <br />performed prior construction to identify purple martin nesting activity. If active nest sites <br />are located, then access road development plans and/or drill hole locations will be <br />modified so that nest sites are not adversely affected or development timing be <br />constrained to preclude impacts during the breeding season (May 1 - July 31). <br />Water Resources <br />14. No refueling or lubricating would take place within 100 feet of wetlands and other <br />waterbodies or drainages. Heavy equipment, hazardous materials, chemicals, fuels, etc. <br />will not be stored within 100 feet of wetlands or surface waters. <br />15. No soil generated from excavation, site preparation, or other operations shall be <br />deposited within 100 linear feet of wetlands or surface waters. <br />16. Sedimentation control devices will be used along roads and drill pads as directed by the <br />USFS representatives. Devices may include, but are not limited to vegetation from <br />clearing, excelsior wattles, straw bales, etc. <br />17. A minimum of 2 feet of freeboard in the mud pit would be maintained between the <br />maximum fluid level and the top of the berm. <br />18. Any exploration drill holes that encounter water and are selected to become long-term <br />ground water monitoring holes must be approved by the Forest Service. <br />Vegetation <br />19. Revegetate disturbed soils by the end of the first growing season. <br />20. All merchantable timber cleared from the-access road and pad will be cut into maximum <br />8' lengths and decked along NFSR 711, allowing for public assess to the material. <br />21. Any slash generated from vegetation/tree removal operations shall be lopped and <br />scattered to a maximum depth of 2 feet. <br />22. MCC will be responsible for controlling noxious weed infestations on all NFS project <br />disturbance until final reclamation is accepted by the Forest Service. Any herbicides <br />used must be EPA approved and will be applied at the recommended rates. <br />23. Reseeding will be completed using a certified weed free seed mixture as approved by <br />the Forest Service District specialist. <br />24. Reclamation efforts will be diligently pursued to insure that a minimum of ground cover is <br />established on all disturbed areas; a minimum 80% of the surrounding undisturbed <br />areas. Reclamation of pad sites and road decommissioning will involve regrading to <br />approximate original contour, reestablishing drainage, soil replacement, and reseeding <br />the disturbed areas. Reclamation activities will commence immediately after drilling <br />activities are complete. The land surface will be returned to approximate original contour, <br />and seeded with the approved seed mix for National Forest System lands. All disturbed <br />areas shall be seeded with the approved seed mixture immediately to prevent noxious
