III. COMMENTS -COMPLIANCE <br /> Bowie No. 1 C-1981-038 <br /> 15 July 2009 � <br /> Page 1/2 <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Bowie No. 1 Mine conducted by Jim Stark of CDRMS on the <br /> afternoon of 15 July 2009. Basil Bear of BRL accompanied me on the inspection. The Bowie No. 1 <br /> Mine is inactive. The mine has undergone Partial Phase I Bond Releases on portions of the loadout, <br /> the West Mine and the East Mine. Currently the operator is performing backfilling and grading <br /> operations on the East Mine area. The weather was warm and overcast and the ground was dry. <br /> Roads: The haul road at the East Mine was well maintained and stable at the time of the inspection. <br /> The operator was blading the road, although there did not appear to be any problem spots. <br /> -The road to the West Mine was also well maintained and stable at the time of the inspection. <br /> Hydrologic Balance: The rock-lined channel on the east side of the mine reclamation (which <br /> basically goes straight down the reclamation) appeared to be stable at the time of the inspection. The <br /> riprap was installed in the channel properly and appeared to be "locked"together to limit its movement <br /> down the channel. Basil Bear indicated that there was no fabric used under the rock. <br /> - The rock-lined channel that follows the remaining road was also stable at the time of the inspection. <br /> The contractor was working on cutting in an upper part of this channel (with an excavator)that does <br /> not need to be riprapped. <br /> -There are several sections of the ditch by the shop and warehouse bench that will need to be <br /> completed. Basil Bear indicated that the contractor would be working on those sections soon. <br /> - Ponds W1 and W2 (at the West Mine) contained a small amount of water. The pond embankments <br /> were well vegetated and appeared to be stable. No erosional features were noted on the pond <br /> embankments. <br /> Backfilling and Grading: It appears as though the majority of the backfilling operations at the East <br /> Mine are complete. Basil Bear indicated that there are still a few areas that need some minor work <br /> but the major dirt moving has been completed. The operator was not doing any earthwork while we <br /> were on site. There did not appear to be any settling of the backfill at the time of the inspection and <br /> no major cracking was observed. No erosional features were noted on either the newly backfilled <br /> areas (backfilled since last fall or the areas that have been backfilled, topsoiled and seeded. The <br /> operator is doing a good job at pocking all of the surfaces with an excavator to help control runoff and <br /> erosion. <br /> - The regraded ROM pile area also appears to be stable. There were no erosional problems noted on <br /> this area. <br /> - The backfilled and regraded West Mine area looked very good at the time of the inspection. The <br /> area appeared to be stable. There was no visible settling, cracking or slumping of the backfill. The <br /> area is well vegetated and no erosional features were seen. <br /> Processing Waste:-The large gob pile just below the turn-off top the crusher level appeared to be <br /> stable at the time of the inspection. Basil indicated that this was the area where the remaining coal <br /> material was placed prior to reclamation. <br /> Revegetation/Reclamation Success: -The reclamation at the West Mine appears to have <br /> progressed nicely. The area is well vegetated and appears to be stable. <br />
