An odor <br />control plan must be approved by the County. <br />(A) Any minor or routine expansion of either a <br />permitted livestock confinement facility or a <br />pre-existing ("grandfathered") livestock <br />confinement facility may be granted by the <br />Planning Administrator as a Conditional Use. <br />(B) Any expansion of a permitted or pre-existing <br />livestock confinement facility which is in <br />excess of minor or routine shall require a <br />permit pursuant to Sections 4-240 and <br />following of these regulations. <br />4-290 Health of Animals <br />All confined or pastured livestock must be <br />kept in a safe and healthful condition. All <br />cases of animal cruelty will be prosecuted to <br />the full extent of Colorado law. <br />4-295 Land Use Map and Ownership <br />Applicants for an livestock confinement <br />facility special use permit must file an existing <br />land use (by type and location of use) map <br />and an ownership map (showing ownership by <br />parcel and location and notification addresses) <br />as part of their application. <br />c 4=300 Notification <br />All property owners within thirteen hundred <br />and twenty feet (1,320') of the livestock <br />confinement facility property ownership <br />boundary shall be notified of the Planning <br />Commission special permit hearings for the <br />livestock confinement facility. <br />4-305 Residential Siting Policy <br />It is the policy of Morgan County to <br />discourage and/or deny applications for <br />4-285 Expansion <br />residential subdivisions, residential <br />subdivision exemptions and home <br />construction within thirteen hundred and <br />twenty feet (1,320') of an animal confinement <br />operation, packing plant, slaughter house, or <br />rendering plant sited under these Regulations <br />without a use by special review. Should such <br />a use by special review be granted in order to <br />meet the needs of a property owner under <br />hardship conditions, then a deed will also be <br />recorded by the property owner at the time of <br />granting the use by special review noting that <br />the property owner acknowledges full <br />knowledge ' that a' permitted animal <br />confinement operation, packing plant, <br />slaughter house, or rendering plant was <br />located closer than thirteen hundred and <br />twenty feet (1,320') from the residence. <br />KENNELS <br />4-320 Location Restrictions <br />Kennels shall be located a minimum of six <br />hundred sixty feet (660') from any existing <br />residence, public place of assembly, occupied <br />commercial building, or any residential <br />building site for which a building permit has <br />been issued as measured from the permitted <br />building footprint. This requirement shall not <br />be applied to a residence occupied by the <br />operator of the kennel or a family member or <br />any employee of the operator. <br />4-325 Application Requirements <br />All applications for conditional or use by <br />special review permits for kennels shall be <br />accompanied by the following documents: <br />-100 <br /> <br />
