<br />Resolution 2008 BCC 52 <br />Page 2 <br />0 C, <br />C. All on and off-site impacts have been satisfactorily mitigated. <br />d. The special use proposed has been made compatible with surrounding uses <br />and is adequately buffered from any incompatible uses by distance and <br />topography. <br />e. The special use poses no or minimal risk to the public health, safety and <br />welfare. <br />f. The special use proposed is not to be developed on a nonconforming parcel of <br />land.. <br />g. The applicants have adequately documented a public need for the project in <br />the form of increased economic development. The applicants have submitted <br />all pertinent technical information, have demonstrated that they have <br />adequate financial resources to implement the project, and have paid all fees <br />and review costs. <br />3. CONDITIONS: <br />a. The applicant is required, as a condition of this permit, to furnish any <br />purchaser or other successor in interest to the, permitted property with a copy <br />of the Morgan County Right to Farm Policy/Notice as adopted by Resolution <br />96 BCC 41 on July 23, 1996, and amended by Resolution 2008 BCC 34 on <br />September 2, 2008 and the Receipt and Statement of Understanding of said <br />policy. The Policy and Receipt and Statement of Understanding shall be <br />recorded as addenda to any deeds conveying the permitted property from the <br />applicant to any purchaser or other successors. <br />b. Any past, existing, or future drainage problems on this property are the <br />responsibility of the: landowner and not that of Morgan County. <br />C. Only concrete and asphalt will be allowed to be stock piled and recycled on <br />this site. No other building materials or waste are included in this permit. <br />d. This permit is specifically. conditioned on all information presented in the <br />application being followed. All information contained in the application or <br />presented by the applicant at public hearings is deemed to be a portion of this <br />permit and must be specifically followed. <br />. <br />2
