You are correct that the due date for the long-term dewatering plan is 60 days from Board <br />Order of 27 May 2009, which would be 26 July 2009, but since that is a Sunday, the effective due date is <br />27 July 2009. <br />MV-2009-015. The Amendment is due 60 days from the Board Order of 11 June 2009, which would be 9 <br />August 2009, that is a Sunday, so the effective due date is 10 August 2009. You certainly can submit the <br />Amendment on 27 July 2009 along with the dewatering plan, but you have until 10 August. <br />Basically here are your options: <br />1) These abatements could be submitted under a single amendment using the earliest compliance date <br />(26 July 2009) as the required submittal date or; <br />2) You could submit a separate technical revision for the de-watering plan using the required <br />abatement date for that submittal with a separate amendment for the backfill to follow later or; <br />3) If you want to combine them in to a single amendment using the latter date (10 August 2009) you <br />will need to go back to the Board and request an extension for the dewatering violation. <br />And a reminder.
