Furthermore, Schmidt has agreed to modify the actual location of the proposed
300 acres to preserve continuity of the Piedmont grassland by eliminating the potential of
bifurcating the Piedmont grassland. The selection of areas to be mined will leave
corridors between mining areas 1 U and 2U as depicted on snaps provided to Arapahoe
County by Schmidt and a bridge of unmined land approximating 53 acres in what is
shown as Area I L. Specific terms that identify the mining areas and the areas to be
protected are set forth in the attached Letter Agreement dated June 20, 2008. This Letter
Agreement modifies the Operations Plan. previously approved by the Board.
The Board believes that this is a good solution to preserving the Piedmont
grassland and it follows the conservation motive envisioned during the concept stage
of the project'. The Board supports this amendment as agreed to above and respectfully
requests that Arapahoe County grant the USR permit to Schmidt.
Since
r' even D.
