The County will provide a list of observed holidays. <br />The hours of operation will be limited in the summertime from 7:30 AM to <br />7:30 PM with no crushing on Saturdays, Sundays and Holidays. <br />There is no limit on the tonnage that may be removed from the property. <br />The Applicant shall only crush materials removed from the subject property. <br />There is no limit on the amount of material that may be crushed. <br />The hauling route will be limited to the portion of D.5 from the property to <br />Highway 17 via Broyles Bridge unless, and only unless, the Applicant is <br />hauling gravel to Osier. If hauling to Osier the Applicant must use the Forest <br />Service Road unless for some reason that access is closed. <br />Prior to commencement of operations, the Colorado Department of <br />Transportation (CDOT) must authorize the ingress and egress to the subject <br />property from State Highway 17. An access permit must be obtained from <br />CDOT by the Applicant if required. The County will not be the applicant or <br />the holder of this permit. If not required the Applicant must provide the <br />County with a letter from CDOT stating that it is not required. The County <br />will not be liable if anything should occur at the intersection of County Road <br />D.5 and State Highway 17. The Applicant shall indemnify and hold the County <br />harmless from any such liability. <br />The traffic plan shall comply with the requirements of the Colorado <br />Department of Transportation and include any devices to improve safety of the <br />intersection as deemed necessary by CDOT. <br />The Applicant shall work with the County to insure that the haul route is <br />graveled. <br />The Applicant will assist with dust abatement on the haul route. It is <br />mandatory that the dust suppression system discussed in the Applicant's <br />proposal be used. <br />Truckloads will be covered per CDOT regulations. <br />Mining and reclamation shall be done per the Colorado Mined Land <br />Reclamation Board Regulations. <br />Erosion control will be accomplished on an on-going basis <br />The bottom of the excavated area will be at ground level (no pit allowed) and <br />will be maintained at the high water mark of the river. <br />The affected area shall be re-vegetated with native species at least equal to the <br />natural vegetation of the surrounding area. <br />The Applicant shall submit a report to the Land Use Office every six months <br />showing the tonnage hauled and the status of the operation. <br />A yearly report must be submitted to the Land Use Office and the Board of <br />County Commissioners as to the amount of material remaining and the <br />projected completion of the project. <br />4
