Jacob Bauer, Martin and Wood <br />July 2, 2009 <br />this plan. <br />DEPLETIONS <br />Page 2 <br />You have provided a monthly breakdown of lagged depletions at this site in your attached <br />Table 2. The stream depletion model was developed based on the following assumptions: the <br />exposed surface area is 2,030 feet from an active stream, the transmissivity is; 100,000 <br />gal/day/ft, the specific yield is 0.2, and the location of the impermeable boundary is 7,875 feet <br />from the live stream. Table 2 shows that during the period January 2009 - December 2009 the <br />lagged stream depletions are estimated to be 26.48 acre-feet and for the period January 2010 - <br />December 2010 the lagged stream depletions are estimated to be 26.43 acre-feet. These <br />estimates are based upon evaporative losses from the settling and washing ponds, mined cell, <br />and dewatering trench, water removed in the mined product, and water used for dust <br />suppression. (See attached Table 1.) <br />REPLACEMENTS <br />The proposed sources of replacement water for this pit are a five year lease to deliver 66 <br />acre-feet for the period of April 1, 2008 through March 31, 2009 of fully consumable water from <br />the Board of Water Works of Pueblo (PBWW), and an additional one-year lease of 30 acre-feet <br />of water commencing April 1, 2009, with an option to extend the lease for an additional year. The <br />lease water will be provided from the Board's stored water at Clear Creek Reservoir, Turquoise <br />Reservoir, Twin Lakes Reservoir, Pueblo Reservoir, from direct flow transmountain water or <br />from any other reservoir or place from which the Board may legally deliver water, and will be <br />delivered to Arkansas River at or near Nyberg Road. The monthly depletions and replacement <br />requirements are provided on the attached Table 2. A transit loss of one percent was applied to <br />the required monthly replacement amounts, as shown in Table 2. Estimated replacements are <br />therefore 26.74 acre-feet for the period January 2009 - December 2009, and 26.71 acre-feet for <br />the period January 2010 - December 2010. <br />The St. Barbara Sand and Gravel Mine operation possesses a corporate surety bond in <br />the amount of $410,693 held with the Division of Reclamation, Mining, and Safety. The amount <br />is available to cover the cost to line or backfill the pit in the event the operator abandons the <br />project and/or allows the dewatering operation to discontinue. <br />CONDITIONS OF APPROVAL <br />I hereby approve the proposed substitute water supply plan in accordance with §37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This plan shall be valid through December 31, 2010 unless otherwise-revoked or <br />modified. <br />2. If this plan will not be made absolute by a water court action by the plan's expiration date, <br />a renewal request must be submitted to this office with the statutory fee (currently $257) <br />by November 15, 2010.
