III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Partial Inspection of the Bowie No. 1 Mine conducted by Marcia Talvitie of the <br /> Colorado DRMS on the afternoon of 09 June 2009. The day commenced at the BRL office at <br /> 1:15 p.m., when I notified Basil Bear that I would be conducting an inspection. Areas covered <br /> during the inspection were the Loadout, the Highway Coal Stockpile Area, and the ongoing <br /> reclamation work at the East Mine. The weather was cloudy and sprinkling. <br /> Roads <br /> • Narrowing of the East Mine haul road has been completed as far as the first turn (Figure 1). <br /> An additional segment has been narrowed and realigned at the hairpin turn further up the <br /> hill. This process was continuing up the road. <br /> • The road to the West Mine had been recently graded and was in good shape. <br /> • The road to the Highway Coal Stockpile area was dry and drivable. <br /> Hydrologic Balance <br /> • Silt fence and/or straw bales have been installed on the downhill side of al! areas disturbed <br /> for the haul road narrowing project (Figure 2). <br /> • Water was visible in Ponds 1, 2 and 3 and the West Ridge pond (Figure 3). <br /> • It appeared that a sizable precipitation event had occurred recently. There was evidence <br /> of runoff from the D-Seam Portal slope, into the roadside ditch, and down the steep <br /> riprapped channel across the reclaimed crushing/screening bench. All runoff was <br /> contained within the permit boundary: the system of ditches and ponds appeared to have <br /> functioned successfully. <br /> • Throughout the East Mine, erosion and sediment control was excellent. Ditches had been <br /> graded, culvert inlets were protected, silt fence was installed, and many slopes have been <br /> roughened. <br /> Backfill & Grading <br /> • Material excavated in the road narrowing process and also from the roadside ditch above <br /> the former D-Seam Portals was being hauled to the former Warehouse Bench to backfill the <br /> area (Figure 4). <br /> Reveaetation and Weeds <br /> • Vegetative growth was appearing on the upper slopes at the East Mine that were seeded in <br /> 2008. Grasses and some annual weeds were observed (Figure 5). <br /> • The topsoil hauled in from the well field and placed on the slope below the warehouse <br /> bench is supporting rapid growth of a number of annual weeds and some grasses. Some <br /> Whitetop was observed,which is a noxious weed that needs to be treated accordingly. <br /> • Slopes and light use roads around Ponds 1 and 2 had been hydro-mulched and seeded. <br /> • Russian knapweed was growing on the cut slope above the West Mine access road. There <br /> was a large stand of Canada thistle on the slope below the road (above Pond W-1). <br /> • The reclaimed slope at the West Mine, viewed from a distance, appeared to be green and <br /> well-vegetated (Figure 6). <br /> Bowie No. 1 Mine C-1981-038 09-Jun-2009 <br />
