The TR contained a letter from Petros & White, LLC <br />(Cemex's water attorney) to the Assistant Division Engineer, Division 1, Colorado <br />Division of Water Resources and to the Water Commissioner, District 5. Since <br />that time there has been additional correspondence between these parties. <br />Attached are two letters, one from the Division Engineer approving Cemex's <br />proposal with some additional conditions, and the other from Petros & White, <br />LLC accepting those conditions on behalf of Cemex. This correspondence <br />demonstrates that Cemex has resolved the issues related to ponded surface <br />water runoff in the Dowe Flats quarries. <br />Please include these documents in the TR file and let me know if you have any <br />questions. <br />Sincerely, <br />Paul T.
