III. COMMENTS - COMPLIANCE <br /> Eagle Mines C-1981-044 <br /> 19 June 2009 <br /> Pg 1/2 _ <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken <br /> during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Eagle Mines conducted by Jim Stark of <br /> CDRMS. Brian Watterson of BTU-Empire accompanied me on the inspection. The <br /> mine is currently in temporary cessation and is only performing maintenance and <br /> monitoring activities. The inspection was conducted on the morning of 19 June 2009. <br /> The weather was warm and sunny and the ground was a bit damp but not muddy <br /> from the recent rains in the area. On 22 May 2009 the Division Proposed a Decision <br /> to Approve with Conditions Permit Renewal 05. <br /> Availability of Records: All of the necessary records were available at the mine site as <br /> noted. The records were brought to the inspection in three-ring binders by Brian <br /> Watterson. Please see the DBMS Availability of Records form at the end of this <br /> inspection for more detailed information. <br /> Signs and Markers: - All of the necessary signs were in place as required. The <br /> entrances along the west and east of Colorado Highway 13 all have the appropriate <br /> signs. Stream buffer zone (and buffer zone exemption) signs were also in place as <br /> required. All of the topsoil piles inspected had the proper signage as did the <br /> disturbed boundary. <br /> Roads: - The mine access road was a bit wet but not muddy and in good condition. <br /> The road is well maintained and appeared stable at the time of the inspection. <br /> There were no erosional problems noted on the road at the time of the inspection. <br /> - The access roads on the east side of the mine were all a bit wet as well but not <br /> muddy either. All of the roads were well maintained and appeared to be stable at <br /> the time of the inspection. <br /> Hydrologic Balance: - The Mine 5 dewatering ponds, 5-P5, 5-P6 and 5--P7, all <br /> contained water and were all stable and well vegetated at the time of the <br /> inspection. The ponds were discharging into the Williams Fork at the time of the. <br /> inspection (from the outfall from Pond 5-P7). <br /> - Sediment Ponds 9-P7 and 9-P81 by the old B&S building, were both dry at the time <br /> of the inspection. The pond embankments were all well vegetated and stable at the <br /> time of the inspection and there were no signs of erosion. <br /> - Sediment Pond 9A-PI was dry at the time of the inspection. The pond embankment <br /> was well vegetated and appeared to be stable. No erosional problems were noted <br /> on the pond embankment at the time of the inspection. <br /> - Sediment Ponds 9-P2 and 9-P3 are a series of ponds on the east side of the site for <br /> old, reclaimed areas. Both ponds were dry at the time of the inspection. Both pond <br /> embankments were well vegetated and appeared to be stable at the time of the <br /> inspection. No erosional problems were noted on either pond embankment. <br />
