III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 18 June 2009 <br /> Pg 1/3 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken <br /> during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Colowyo Mine conducted by Jim Stark of CDRMS. <br /> The inspection was conducted on 18 June 2009. Andy Thompson of C-CC <br /> accompanied me in the morning and Tay Tonozzi accompanied me in the <br /> afternoon, The mine was actively mining coal and hauling coal to the loadout at the <br /> time of the inspection. The weather was warm and overcast and it was raining on <br /> and off during the inspection. The ground was wet and muddy in spots due to the <br /> rain. <br /> Roads: - The main access road and haul road to the Gossard Loadouit is a paved <br /> road. The road was wet at times (due to the rain) and in good condition, <br /> - The light-use road in the Taylor Draw was inaccessible due to the rain, <br /> - The haul roads in the East Pit, West Pit were all stable and well maintained at the <br /> time of the inspection. There was not a problem with fugitive dust from the roads due <br /> to the rain and no erosional problems were noted. <br /> - The haul roads in the South Taylor Pit were all mostly dry and there was not a <br /> problem with fugitive dust at the time of the inspection. Colowyo is currently working <br /> on a new road on the west edge of the West Pit into the South Taylor Pit, which will <br /> replace the road through the old Section 16 Pit. The Division just received the <br /> Colowyo responses to the Technical Revision 76 PAR letter and is currently reviewing <br /> them. <br /> - The Sturgeon road was well maintained and stable and there were no erosional <br /> problems noted. The Missouri crossings along the road remain in good condition. <br /> The road surfacing has held up well and all of the roadside ditches were clean and <br /> functioning properly. <br /> Hydrologic Balance: - The Wash Bay Pond (not a NPDES discharge point) was not <br /> inspected. <br /> - The Work Area Pond (NPDES 002A) contained water approximately 'l-1/2 feet below <br /> the top of the discharge pipe (just below the weep hole) and was not discharging at <br /> the time of the inspection. The embankment was well vegetated and stable and no <br /> erosional problems were noted. The emergency spillway appeared to be stable. <br /> - The Gossard Pond (NPDES 003A) was not inspected. <br /> - The West Pit Pond (NPDES 008A) was not inspected. <br /> - The Rail Loop Pond (NPDES 006A) was not inspected. <br /> - The Stoker Siding Pond (NPDES 005A) was not inspected. <br /> - The East Taylor Pond (NPDES O1 OA) was not inspected, <br />
