On May 26`h, 2009 the Routt County Board of Commissioners approved the Special Use Permit for the amendment to the Camilletti Milner Pit #2. We are currently working with County Staff to address several conditions of that approval that must be complete prior to the County issuing the signed Special Use Permit. We will forward you a copy of the meeting minutes and signed Special Use Permit when they are ready. / The following are responses to items from the "Observations" section of your Inspection Report dated May 18, 2009. ? 1. Precision Excavating, Inc. will commit to not mining within 200 feet of the Xcel gas line and the Yampa Valley Electric power line until structure agreements are! provided to the Colorado Division of Reclamation, Mining & Safety. Attached is a copy of the notice sent to Xcel Energy and Yampa Valley Electric as well as copies of the certified mail receipts. 2. Attached is a Revised Exhibit L: Reclamation Costs that establishes an updated financial warranty amount based on the new maximum area of disturbance. 3. We are preparing a Gravel Pit Well Permit Application that will be submitted to the Colorado Division of Water Resources. We have been in contact with the local Division of Water Resources office to discuss the project. Precision Excavating, Inc. acknowledges that a Well Permit must be obtained before exposing groundwater in the expansion area. 4. A 404 Permit Application is being prepared for submittal to the U.S. Army Corps of Engineers. Precision Excavating, Inc. commits to not disturbing the wetlands prior to receiving a 404 Permit from the Corps. 5. Precision Excavating, Inc. agrees to submit construction details for the proposed bridge and conveyor structure over Trout Creek to the Division prior to construction. The following provides a description of the offsets of the Yampa River to the proposed expansion area pit boundary.
