Binns <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RECEIVED <br />JUN 2 -L 2009 <br />Division oT Reclamation, <br />Mining and Safety <br />Re: Foidel Creek Mine (Permit No. C-1982-056), Permit Revision Application No. 8 (PR-8), Western <br />Mining District Expansion <br />Dear Ms. Binns: <br />Thank you for your correspondence dated May 29, 2009 (received by our office on June 2, 2009) <br />regarding the subject expansion activities at the Foidel Creek Mine. <br />Our office is concerned with the direct and indirect effects of underground coal training at the Foidel <br />Creek Mine on cultural resources, and therefore cannot agree with the requested determination of "no <br />adverse effect." <br />Based on the location information provided within the documentation, a search of our database has <br />indicated that a number of cultural resource surveys have previously been conducted within the permit <br />area. <br />Our records indicate that at least 36 cultural resources which are eligible or potentially eligible for the <br />NRHP and one resource which is listed on the NRHP have been recorded within-the current permit <br />area.
