Stipulation No. 3: NO SUBAREA OF THE REFUSE DISPOSAL AREA SHALL BE <br />DISTURBED BY MINING ACTIVITIES UNTIL THE APPLICANT HAS DEMONSTRATED <br />TO THE REGULATORY AUTHORITIES' SATISFACTION THAT SUFFICIENT NON- <br />TOXIC MATERIAL IS AVAILABLE TO COMPLY" WITH RULE 4.10. <br />Status: This stipulation was satisfied and terminated on 10 August 1981. <br />Stipulation No. 4: A PLAN MUST BE SUBMITTED, TO THE REGULATORY AUTHORITY <br />WITHIN 30 DAYS OF APPROVAL OF THIS MINE PLAN FOR THE HANDLING AND <br />DISPOSAL OF MATERIAL IN THE "STORAGE AREA" AND A POST-MINING <br />TOPOGRAPHIC MAP OF THE RAILROAD STORAGE AND LOAD OUT AREAS. <br />Status: This stipulation was satisfied and terminated on 27 August 1981. <br />Stipulation No. 5: THE APPLICANT WILL INCORPORATE OVERBURDEN ANALYSES <br />SUBMITTED TO THE REGULARY AUTHORITY ON MAY 29, 1981, INTO THE MINE <br />PLAN WITHIN 30 DAYS OF APPROVAL OF THE PERMIT. <br />Status: This stipulation was satisfied and terminated on 23 September 1981. <br />Stipulation No. 6: THE APPLICANT MUST SUBMIT A MONITORING PLAN FOR THE <br />WHITE RIVER ALLUVIUM TO ENSURE THAT DRAWDOWN PROJECTIONS ARE NO <br />LARGER THAN ANTICIPATED AND THAT THE MONITORING OBJECTIVES OF <br />SECTION 4.24.4 OF THE COLORADO PERMANENT REGULATORY PROGRAM ARE <br />MET. THIS INFORMATION MUST BE SUBMITTED TO THE REGULATORY <br />AUTHORITY WITHIN 90 DAYS OF THE GRANTING OF THE PERMIT. <br />Status: This stipulation was satisfied and terminated on 27 October 1981. <br />Stipulation No. 7: THE APPLICANT MUST ALSO COMMIT TO PROVIDING A <br />MITIGATION PLAN SHOULD THE EFFECTS OF DRAWDOWN IN THE WHITE RIVER <br />ALLUVIAL AQUIFER DETRIMENTALLY AFFECT ESTABLISHED AGRICULTURAL <br />ACTIVITIES, EITHER THROUGH UNFORESEEN IMPACTS OR FROM GROUNDWATER <br />DEPLETIONS WHICH ARE LARGER THAN EXPECTED. <br />Status: This stipulation was satisfied and terminated on 9 May 1986. <br />Stipulation No. 8: PRIOR TO THE DEVELOPMENT OF MAINS AND SUB-MAINS <br />BENEATH THE ALLUVIAL BODY OF RED WASH, THE APPLICANT MUST SUBMIT <br />THE INFORMATION REQUIRED BY SECTION 2.06.8(4) OF THE COLORADO <br />REGULATORY PROGRAM, ALONG WITH THE :PLAN TO ENSURE THAT THE <br />PERFORMANCE STANDARDS AND MONITORING REQUIREMENTS OF SECTION 4.24 <br />ARE MET. THIS PLAN MUST ADDRESS THE ANALYSIS OF SUBSIDENCE <br />MONITORING DATA UNTIL THE SUBMITTALS ARE APPROVED BY THE <br />REGULATORY AUTHORITY. <br />Status: This stipulation was satisfied and terminated on 9 May 1986. <br />Deserado Mine 6 June 18, 2009
