III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Backfilling and Grading <br /> The East Wadge area was inspected by walking from the junction of Roads C and F, to the CSU shrub plot <br /> location, and then down and across slope through the PM-8 watershed to Pond 008. The steep slopes in the <br /> area have been subject to significant erosion and erosion repair efforts in the past, and erosional stability of the <br /> watershed was the focus of my observations. No repairs had been conducted in the area to date this spring. An <br /> upper segment of the PM-8 channel was marked by the operator for repairs on the 2009 rill and gully survey <br /> map. The following observations were made during the walk through the East Wadge area. <br /> • A few short hillslope gullies, 8-12"deep in some locations were noted on slopes in the vicinity of the <br /> shrub plots, upslope of the upper erosion control ditch (V-Ditch#1). Hand work repairs such as small <br /> rock checks, straw wattles, etc., would be appropriate in these locations. <br /> • Similar measures may be warranted in areas of concentrated rill erosion within the unfenced seeded test <br /> plots north of the fenced plots. <br /> • There appeared to be areas of side scour, exposed underliner, and downcutting along various segments <br /> of the PM-8 Channel, extending further down along the length of the channel than identified for repair on <br /> the 2009 R&G survey map. Downcutting was observed at a couple of the transition points where the <br /> erosion control V ditches enter the main PM-8 Channel. Sidecutting was noted in locations where riprap <br /> did not properly extend up the sides of the channel; re-shaping and redistribution of riprap will be <br /> necessary in these areas. Operator should ground check the entire length of PM-8 and repair as <br /> warranted. <br /> • The series of erosion control V ditches in the PM-8 watershed appear to have been effective in <br /> controlling erosion on the steep slopes, and previously repaired rill and gully locations appear to have <br /> held up. The small slide located east of PM-8 near the disturbed area boundary showed no indication of <br /> renewed movement. <br /> Certain other locations where erosion repair or preventive measures are warranted are noted in recent <br /> inspections reports, and include upper PM-6, erosion associated with a temporary diversion above Road F south <br /> of Stock Pond T-30, and a previously repaired gully location subject to concentrated flow from snow drift <br /> locations below Road E-1, south of the upper end of PM-22. These locations are marked on the 2009 R&G <br /> Survey Map. <br /> The Pre-law area that has not been released from bond, and which includes the area of acid affected spoils that <br /> were graded, limed, and seeded in the fall of 2007 were observed. The area appears to have remained stable, <br /> with no significant erosion or instability evident. Vegetation cover remains somewhat patchy and sparse over-all, <br /> but is already improved over conditions prior to remedial treatment. 2008 was only the first growing season, and <br /> growth has only recently initiated this spring. <br /> Revegetation/Reclamation Success <br /> The reclaimed landfill area in the upper PM-10 watershed was topsoiled and seeded last fall. The annual wheat <br /> cover crop seeded with the permanent mix had recently germinated on the topsoiled areas. <br /> Because vegetation establishment was scrutinized over large areas of the permit in the Phase II bond release <br /> last year and observations were documented, vegetation observations during this inspection were focused on <br /> the East Wadge area that was not included in the Phase II release request area, and the CSU shrub <br /> establishment test plots within the East Wadge Area. <br /> Within the test plots, it was noted that the tubeling tall shrub species within the fenced portion of the plots still <br /> appear to be thriving. Within the seeded areas both within and outside of the plot, and in various older stands in <br /> the permit area, it was noted that arrow leaf balsamroot forbs were near peak of flowering, and were quite showy <br /> and surprisingly abundant. Also, it was apparent that growth of seeded shrubs was best within the deep soil (50 <br /> 4 <br />
