III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Permanent Channels <br /> Upper watershed channels could not be accessed. Lower watershed channels that could be viewed were not <br /> flowing, with the exception of YPM-6-3 and tributary that was flowing from spoil discharge. Segments of <br /> Channels YPM 6-2, and YPM-7, were severely scoured and will require grading and TRM mat replacement and <br /> new installation in some reaches. The operator's 2009 Rill and Gully survey map identifies a large number of <br /> additional permanent channel segments that will require maintenance. A more thorough inspection of these <br /> locations will be made during the June inspection, when site access is improved. <br /> Sediment Ponds <br /> Sediment Ponds 12, 12A, 13, and 14 were accessible and were inspected. All of the ponds contained open <br /> water and all were discharging, with the exception of Pond 12A. Discharge water was clear at the ponds that <br /> were discharging. Pond 12A water level had obviously gone down rapidly, apparently due to infiltration into the <br /> spoil beneath the pond. The spoil spring that emerges near the downstream toe of the Pond 12A embankment, <br /> first noted during the April 2009 inspection, was continuing to discharge considerable flow. <br /> Backfillinc and Grading; Slides & Damage <br /> The operator has completed and submitted the 2009 Rill and Gully survey map, which identifies numerous <br /> erosion features and slide features that will require repair during the 2009 field season. The Division will assess <br /> these topics more thoroughly in a subsequent inspection, when site conditions allow for better access to the <br /> entire mine area. During this inspection, observations focused mainly on the lower portions of the Pond 12 <br /> watershed, a significant area of which is designated "Slide Remediation Area" on the R&G map. Monitoring and <br /> assessment of the Pond 12 slide(described in previous inspections) is on-going; remedial plan is to be <br /> developed and submitted later this year. <br /> A few erosion and slide features within the Pond 12 watershed were noted during the field inspection that do not <br /> appear to have been delineated on the R&G map, including: <br /> • Ground settling immediately south of Pond 12, with a fresh scarp up to 2 feet or more in height and <br /> approximately 45 feet in length; <br /> • Gully incision along the TRM segment of YPM-7; <br /> • Concentrated rill erosion (from runoff down scraper route)on revegetated slopes north of YPM-6-2. <br /> These features will need to be properly repaired. Measures will need to be taken to prevent recurrence of rill <br /> erosion associated with scraper route flow concentration; installation of closely spaced water bars and/or <br /> additional TRM channels in appropriate locations would appear to be warranted. The scraper route apparently <br /> will need to be left open for future haulage of topsoil to the lower Pond 12 watershed area. <br /> A steep non-topsoiled slope north of YPM-6-1 was viewed from a distance. This slope(located along a former <br /> haul road route between two undisturbed habitat blocks)appears to be heavily rilled, and was marked on the <br /> R&G map for"repair and reseeding". The slope was not topsoiled, as it was located within a "steep slope <br /> topsoil salvage variance area". The area will be viewed more closely during the June inspection, and repair <br /> options will be discussed with the operator. <br /> 4 <br />
