(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1987-113 <br />INSPECTION DATE 06/08/09 INSPECTOR'S INITIALS PSH <br />OBSERVATIONS <br />The Rocky Flats Pit, File No. M-1987-113, was inspected by Peter Hays with the Division of Reclamation, <br />Mining and Safety (Division) as part of the Division's monitoring inspection program. Mr. Myron Moorhead <br />with Bestway Concrete Company was present during the inspection. <br />The Rocky Flats Pit is located in northern Jefferson County, east of State Highway 93, approximately 9.5 miles <br />north of Golden, CO and west of Rocky Flats. The site was previously inspected by the Division on July 10, <br />2007. <br />The Rocky Flats Pit was active during the inspection. The mine pit was being excavated with a backhoe and <br />stockpiled material was being removed from the site. The pit excavation is proceeding from south to north as <br />indicated in the approved mining plan. Water was observed in the pit during the inspection. Mr. Moorhead <br />stated the source of the water was storm water. To avoid a possible violation, the operator must <br />demonstrate the right to retain storm water in the pit. The operator was reminded of the requirement to <br />obtain a discharge permit, if a permit does not exsist for the site, before pumping water out of the pit. See <br />the corrective actions section of this report for the corrective actions and date. <br />The Mine Plan Map on file with the Division and the annual reports submitted by the previous operator do <br />not accurately depict the current mining activity at the site. Per Rule 6.4.3, the Mining Plan Map must show <br />the type of structures and location of all significant, valuable, and permanent man-made structures contained <br />on the area of affected land. The operator agreed to submit a revised Mine Plan Map to the Division that <br />accurately depicts the internal road configuration, Church and McKay ditch locations, stockpile locations <br />and the locations of the concrete batch, processing facility and wash plant locations in the form of a <br />technical revision. <br />A sedimentation pond, wash plant and concrete plant were observed at the site during the inspection. The <br />Division does not have record of the sedimentation pond, wash plant and concrete plant in the permit file. To <br />avoid a possible violation, the operator must within 30 days submit a technical revision to include the <br />concrete plant, wash plant and sedimentation pond to the permit. Alternatively, the operator may backfill <br />the sedimentation pond, end the washing process and provided evidence the concrete batch plant has been <br />removed from the site. <br />The technical revision must include the required $216 fee, all required county or local government permits, <br />including but not limited to an APENS permit, storm water and spill control plan from the Colorado <br />Department of Public Health and Environment and all applicable permit exhibits. Additionally, the technical <br />revision must include documentation of the source of the wash plant water. If the source is groundwater, <br />please provide the Division with proof of a well permit and substitute water supply plan from the Office of <br />State Engineer. If the source is storm water, please provide the Division with proof of the right to retain the <br />water on site. See the corrective actions section of this report for the corrective actions and date. <br />The approved post mine land use for the Rocky Flats Pit is pastureland. Reclamation activities have begun at <br />the site. The southwest corner of the pit has been partially backfilled. Mr. Moorhead stated waste material <br />will be diverted from the processing plant to the south pit highwall starting next month. The material will be <br />used to backfill the benched highwall to the final 3:1 slope. The backfill activities will resolve the non-
