Cattany <br />Oak Creek, CO 80467 Division Director <br /> Natural Resource Trustee <br />Re: Foidel Creek Mine, Permit No. C1982-056, PR8, letters from the U.S. Office of Surface Mining <br />Dear Mr. Nettleton: <br />The Division has received two letters from the Office of Surface Mining (OSM) regarding the Permit <br />Revision application No. 8 (PR8), and one form the U.S. Bureau of Land Management(BLM). The two <br />letters from the OSM were received by the Division on June 11, 2009, and the letter from the BLM was <br />received June 10, 2009. One letter from the OSM is from Mr. Robert Postle, Manager, Field Operations <br />Branch, determining that the revisions proposed in PR8 constitute a mining plan action in accordance <br />with 30 CFR Part 746. The second letter from the OSM is from Mr. Carl Johnston, Natural Resource <br />Specialist, requesting Section 7 consultation with the U.S. Fish and Wildlife Service, regarding PR8. The <br />letter from the BLM is from John Husband, Field Manager, Little Snake Field Office, determining the <br />need for Twentymile Coal Company to modify the Resource Recovery and Protection Plan (R2P2) for <br />Federal Lease COC72980.
