Based on your inspection you estimated that 65o cubic yards of topsoil were not salvaged by <br />the current mining operation. We were never told by the previous or current owners that all <br />topsoil and overburden were to be salvaged as a condition of the MLRB permit. In 2007 <br />when we began mining in the pit we were mining the west wall and that area had been the <br />location of a previous batch plant and scale house that was already topsoil and overburden <br />free since the 196o's. The high walls on the west are just now reaching a point where there is <br />any topsoil to consider. Since you sent us this report we have now changed our current <br />mining operation to correct this matter. There will be enough topsoil generated in the south <br />west corner of the pit to more than compensate for the 650 cubic yards you estimated that we <br />did not salvage. It also appears in your report that the shortage of topsoil goes back to your <br />inspection in 20o6 which is prior to our operations as we began on January 1, 2007. In <br />reviewing the information we have it appears that the topsoil from Tracts 5 & 6, the newly <br />amended area, were used in the calculations to reduce the required bond back in 20o6. It <br />would appear that Reclamation Ridge LLC purchased the pit knowing there would be a <br />shortage of topsoil to reclaim this pit if it did not include Tracts 5 and 6 and it will be their <br />responsibility to import the needed material. <br />Mr. Evans also told you that the eastern amended permit area may be removed from the <br />permit by Mr. Hahn as he is the current property owners and operator of the pit. Just to <br />make this clear, yes Mr. Hahn owns Reclamation Ridge LLC and the land but we are the <br />operators of the pit and we have the mining rights to all of the amended permit area in Tracts <br />5 and 6. This area will be mined and should not be removed from the permit. <br />We would like an opportunity to meet and discuss the operations with you as we want to <br />make sure that we are handling our part of this mining operation correctly. We have not had <br />any communication from the Hahn's directly since the day they purchased this ground which <br />was December 9, 2oo8.
