There are some real discrepancies in what Mr. Evans told you that we feel need to <br />be corrected or clarified regarding the operations at this pit. <br />According to your report you met with Ken Evans from Reclamation Ridge LLC on April 16, <br />20o9 at the Thompson Resource aka Horn Gravel pit as a result of the succession of operator <br />application. Mr. Evans told you that the Flintstone Gravel's lease would expire on July 1, <br />2009. A copy of our lease is attached which clearly indicates that the expiration of it will be <br />December 31, 2011 and we intend to mine this pit for the remainder of that time. You will <br />also find attached a court order dated March 30, 2009 which gives us the right to continue <br />our operation. <br />The imported concrete and rock stockpiles that you observed in several areas of the pit were <br />not imported by us, nor did Flintstone Gravel have any say in who brought that material in, it <br />was in fact imported with the permission of Larry and Gary Thompson who were the previous <br />owners of the pit along with their tenant Sam Conger who operated the batch plant under <br />their permission. No where in our contract with the Hahn's does it say we will remove that <br />material by July 1, 2009. Since Reclamation Ridge purchased the pit from the Thompson's <br />they are the owners of those stockpiles and it will be their responsibility to clean up that area. <br />The demolition of the concrete batch plant is also something that we had no involvement in as <br />it was a structure in the pit before we began operations. We did import some asphalt and <br />that material was recycled and is being sold as a product we offer to our customers.
