111. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Topsoil <br /> The topsoil pile and the construction material pile stockpile are adequately protected. As seen in the <br /> attached Photograph No. 3 both piles have a fairly good vegetative cover on them and are stable with <br /> no erosion evident. <br /> General Mine Compliance <br /> The location of the archeological dig recently conducted by Grand River Institute was inspected and is <br /> shown in Photograph No. 4. The excavated trench beneath the overhang has been covered with a <br /> plastic tarp and temporarily backfilled with dirt and rock. This site(5GF741)has been previously <br /> identified on the permit area and is documented in the cultural resource survey in Appendix J of the <br /> permit application package. The location of the site is beneath the rock outcrop overhang west of the <br /> existing temporary coal waste and sediment storage pile and is within the disturbance area for the <br /> proposed new Coal Mine Waste Disposal Site approved with TR-16. The construction of the new <br /> waste pile and sediment pond is on hold until all issues regarding the archeological site have been fully <br /> resolved. The site is inactive at this time and it has not been determined whether or not further <br /> archeological investigation and surveys will be conducted at this location. <br />
