III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the McClane Canyon Mine conducted by Mike Boulay of the <br /> Division of Reclamation, Mining and Safety on June 4, 2009. Chuck Silengo was present for a portion <br /> of the inspection at the portal and coal stockpile areas. Weather conditions were clear and warm. <br /> Ground conditions were dry. Coal was being loaded and hauled from the mine during the inspection. <br /> Availability of Records <br /> The availability of records was checked at the mine office on the morning of June 4, 2009. See the <br /> attached records checklist at the end of this inspection report. All required records were on file and <br /> available for review. <br /> The AVS Annual Review Inspection Worksheet was completed during this inspection. The <br /> ownership/control information for permittee and operator noted in the field is consistent with what is <br /> listed in the permit application. <br /> Roads <br /> Roads were maintained and in good condition throughout the site. Ditches and culverts were clear of <br /> sediment and debris and functioning properly. At the time of the inspection, MCM was watering roads <br /> for dust suppression. <br /> Hydrologic Balance <br /> Drainage structures and diversion culverts in the portal area were clear of debris and functional. The <br /> large surface water collection sump and diversion located adjacent to the fan is shown in Photograph <br /> No. 1. The diversion structures are very well maintained at the portal facilities area. The mine was <br /> not discharging mine water at the time of the inspection. <br /> The sediment pond was containing muddy water right at the level of the gated principal spillway as <br /> seen in Photograph No. 2. The manually operated pond was not being discharged. The silt fences at <br /> the entrance to the road accessing the construction material and topsoil pile locations and at the east <br /> side of the bridge at East Salt Creek crossing were maintained. All site sediment control features <br /> appeared to be in good working order and no problems were noted during this inspection. <br /> Processing Waste <br /> The temporary coal waste pile area is properly maintained. Waste is adequately contained within the <br /> berm surrounding the pile. The clean water diversion ditch around the waste pile and sediment storage <br /> area is very stable and functional. <br />
