III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete quarterly inspection of the reclaimed Fruita mine permit revocation site, <br /> conducted by Dan Mathews of the DRMS Grand Junction Field Office. A remedial reclamation project <br /> was performed at the site earlier this spring. The Division's Inactive Mine Program (IMP) developed <br /> the maintenance plan and bid documents for the project, utilizing a combination of remaining forfeited <br /> bond funds and a grant from the OSM civil penalties fund. The construction contractor performed the <br /> work in March-early April. <br /> Project tasks completed included: <br /> • Repairs to the central Mine #1 portal entry, where a cavity had formed within the backfill, out- <br /> by the concrete portal seal, resulting in small openings to the surface and drainage of surface <br /> runoff into the cavity. This problem was addressed by filling the outer portion of the cavity with <br /> polyurethane foam to seal the opening off from the surface, followed by replacement of backfill <br /> and a protective rock apron over the hardened foam. <br /> • Repair of a gully on the #1 portal backfill downgradient of the rock apron, including channel <br /> shaping and installation of a series of closely spaced keyed rock checks. <br /> • Repair of a large gully that had formed at the toe of the steep riprap channel that extends down <br /> the outslope of the #1 Mine bench. Repair included channel shaping and installation of large <br /> riprap along the segment of channel immediately downstream of the toe of the outslope, as <br /> well as channel grading and installation of rock checks downstream of the new riprapped <br /> section. <br /> • Gully repair including riprap and/or rock check installation in a number additional locations, <br /> including a segment of the "west fork" channel west of the #2 Portals backfill, along the lower <br /> east perimeter of the #1 mine bench outslope, along a segment of the main drainage channel <br /> upstream of the sediment pond, and along the lower segment of the reclaimed Mine #1 bench <br /> access road. <br /> • Sealing of the damaged CMP primary pond spillway, removal of the primary spillway riser and <br /> associated structure, lowering of the open channel spillway and installation of riprap within the <br /> spillway and within a channel from the spillway to the natural drainage channel below. <br /> • Roughening, seeding, and mulching of all areas disturbed during the remedial project. <br /> • Removal of tamarisk plants from the sediment pond. <br /> A follow-up project is scheduled for this fall, to include roughening and seeding the smoothly graded <br /> #2 portal backfill where seeded vegetation did not establish well, along with remedial seeding of other <br /> areas if warranted, and erosion repairs as necessary. <br /> Weather was cloudy and warm. The sediment pond contained no water; pond bottom was dry. <br /> 3 <br />
