Amendment Application AM-04 <br />b. Letter of 13 MAY 2009, from DRMS, Ref above <br />1. As requested. <br />2. Unfortunately, for various and sometimes unknown reasons, various government <br />agencies have given the Montoya Pit different names. In particular, the BLM has been <br />using several names inconsistently in identifying the same operation. Variations of the <br />name of the permittee/operator/leasee have also been used. <br />3. Since the BLM is the landowner for much of the permitted land, including most of <br />the land included in the current amendment application, and since the various <br />documents using various names for the operation are official documents and part of the <br />record under federal law, these documents even when submitted as part of the <br />application for the amendment to DRMS, cannot be modified, and are essential as they <br />establish the permission of the landowner (the US Government) for the right for C&J <br />Gravel Products, Inc. to mine the area. Discussions indicate that it is not possible to <br />change the names used in federal documents which have already been issued. <br />4. Therefore, this memorandum has been prepared in order to make it clear, for the <br />record and for purposes of submission and review for completeness by DRMS that the <br />same facility is referred to in all cases. <br />5. The "Grandview Gravel Pit," "Montoya Gravel Pit" and other variations of the <br />name used in the documents all refer to the Montoya Pit, CDRMS File No. 1980-146. <br />6. The "C&J Gravel", "C&J Gravel Products" and other variations of the name used <br />in the documents all refer to the same legal entity, C&J Gravel Products, Inc., a <br />Colorado corporation which has been and is the operator of the Montoya Pit. <br />7. It should be further noted that sometimes the electronic copies of the federal <br />documents from which the copies for the amendment application are printed, do not <br />have the actual signature of the federal official. Their validity may be confirmed with the <br />BLM Columbine Field Office in Bayfield, CO, or the San Juan Public Lands Center, <br />Durango, CO; attention Helen Mary Johnson, Helen Marv Johnson(a-)-blm.gov or 970- <br />247-4874. <br />Submitted by: <br />N han rton, CE, PE, DEE, Comptroller, <br />WASTELINE, INC.
