111111. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Mr. Brian Watterson of Twentymile Coal Company accompanied the field portion of the <br /> inspection. The Foidel Creek Mine is a large active underground mine. The mine is currently in the <br /> middle of a longwall move, so no coal was being mined at the time of the inspection. The weather was <br /> mild, dry and partly cloudy on the second day of the inspection. <br /> Near the 18RT borehole the inspector and mine representative encountered a vehicle from West Virginia <br /> with rifles. They turned out to be representatives one of the ranchers, Camelletti, and were shooting at <br /> ground squirrels. Mine personnel was OK with their presence. A helicopter was observed flying low <br /> following the high power transmission lines overlying the Northern Mining District. <br /> Records: TCC explained the apparent missing DMRs for CO-G072758 Jan &Feb 2008. TCC reported <br /> CO-G072272 had expired at the end of 2007. The pond was frozen and snow covered at the beginning <br /> of 2008 and no discharge (or pumping) occurred in early 2008. CDPHE had terminated permit CO- <br /> G072758, so TCC reapplied for a discharge permit, and was assigned CPDS#CO-G072758. As a result, <br /> no DMRs were required for, or were submitted for January and February 2008. <br /> TCC representative reported that a public meeting was held regarding the 18LT ventilation shaft in <br /> accordance with Routt County's requirements. No public comments were received. <br /> The Division has received TCC's application for a Permit Revision for the Western Mining District. <br /> Roads: Haul Roads and access roads throughout the mine are in relatively good condition. Some dust <br /> was apparent from the main access road. TCC is reshaping ditches and cleaning culverts as roads and <br /> ditches begin to dry. Ditches around facilities area are functional, regular clean out of sediment should <br /> continue as part of regular facilities maintenance. <br /> Hydrologic Balance: <br /> TCC was not pumping from TORT at the time of the inspection. TCC stated that last week when the <br /> pump was turned off there was 53 ft. of freeboard in the EMD. TCC continues to have difficulty <br /> meeting discharge parameters from TORT. TCC is accepting proposals for water treatment measures and <br /> will submit a water treatment scheme to the Division once they have reviewed the proposals. Piping <br /> connections are progressing at TORT pad. <br /> 6MN reservoir is holding runoff water. As-built certification for 6MN Reservoir has not been provided <br /> to DRMS yet. This certification needs to be provided to DRMS and on file at the mine. 6MN Upland <br /> Diversion ditch continues to run water and has several pooled areas that may need gradient adjustment. <br /> The Ditch sides are steep but TCC appears to have begun to grade the slopes to a gentler configuration. <br /> The black pipe at the west end of the 6MN reservoir is the 6MN line from the TORT. An additional hole <br /> was begun adjacent to the current line. This hole needs to be filled back in.
