(vacant) <br />1050 17th Street, Suite 950 Secretary <br />Denver, Colorado 80211 <br />RE: Request for Variance, Pump Installation in a Mine Sump, application receipt number 3620165, NE <br />% of the SW A Section 14, Township 44 North, Range 18 West, New Mexico PM. <br />Request No: 2007-117A <br />A request for variance for the installation of pumping equipment in an underground mine sump was <br />submitted along with well permit application receipt number 3620165 on August 15, 2007. The request <br />has been reviewed for the Board of Examiners of Water Well Construction and Pump Installation <br />Contractors. The request is specifically for a variance from the well construction standards to allow the <br />installation of pumping equipment in a mine sump. <br />Pursuant to Board Policy 2000-4 and the authority granted by the Board, the required variance to the Rules <br />• is granted subject to the following conditions: <br />1. Every necessary means and precautions to prevent contaminants from entering the sump shall be <br />taken. <br />2. Pumping equipment shall be installed in accordance with the limitations for production rate <br />specified on the well permit. <br />3. Water from the sump shall be not be used for human consumption. <br />4. Rule 15 concerning disinfection standards is hereby waived for the sump and the installation of <br />pumping equipment in the sump. <br />5. The pump must be installed by a licensed pump installation contractor or by the owner with <br />equipment both owned and operated by the owner. <br />6. A standard Pump Installation and Test Report (Form GWS 32) shall be filed in accordance with <br />Rule 17. <br />Granting the request for variance to minimum well construction and pump installation standards does not <br />relieve the owner of potential responsibility or liability in the event contamination of the water source results <br />from such construction, nor does the grantor assume any responsibility or liability should contamination <br />occur. <br />If you have any questions, please contact this office. <br />Sincerely, <br />Michael P Schaubs, PG <br />Geotechnical Services Branch <br />cc: permit files <br />• <br />TIMOTHY L.
