Compliance with the yearly production limits shall <br />be determined on a rolling twelve (12) month total. <br />9) Emission of air pollutants shall not exceed the following limitations. <br />a) Particulate Matter - Fugitive 36.9 tons per year and 207 lbs per day. <br />b) PM 10 (Particulate Matter <10om) -Fugitive 12.5 tons per year and 70.1 lbs per day <br />10) Compliance with the fugitive particulate matter emissions limits shall be demonstrated by not <br />exceeding the process rate limits, and by applying the control measured. <br />11) Daily emissions rates are based on the maximum daily production of uranium/vanadium ore <br />produced. <br />12) A revised Air Pollutant Emissions Notice (APEN) shall be filed (Regulation No. 3, Part A, II. C): <br />a) Annually whenever a significant increase in emissions occurs as follows <br />i) For any Criteria pollutant: <br />(1) For sources less than 100 tons per year, a change in actual emission of five tons per year <br />or more, above the level reported on the last APEN submitted; or <br />ii) For any non-criteria reportable pollutant: <br />(1) If the emissions increase by 50% of five (5) tons per year, whichever is less, above the <br />level reported on the last APEN submitted by the Division. <br />• b) Whenever there is a change in the owner or operator of any facility, process, or activity; or <br />c) Whenever new control equipment is installed, or whenever a different type of control equipment <br />replaces an existing type of control equipment; or <br />d) Whenever a permit limitation must be modified; or <br />e) No later than thirty (30) days before the existing APEN expired. APEN's expire five (5) years <br />from the date of submittal. <br />13) An analysis of the chemical composition of a site representative ore sample shall be provided to the <br />Division within 180 days of startup. <br />14) This permit and any required attachments must be retained and made available for inspection upon <br />request at the mine site. <br />15) The Operator MUST notify the Division at least thirty days prior to commencement of the permitted <br />operation or activity. <br />16) The Operator must pay an annual fee to the Division to cover the costs of inspections and <br />administration. If a source or activity is to be discontinued, then the owner must notify the Division <br />in writing requesting a cancellation of the permit. <br />17) Violations of the terms of a permit or of the provisions of the Colorado Air Pollution Prevention and <br />control Act of the regulations of the Air Quality Control Commission may result in administration, <br />civil or criminal enforcement actions under Sections24-7-115, -121, -122, -122.1, Colorado Revised <br />Statute. <br />0
