Therefore Cemex owns this property, however it has technically <br />been removed from the permit boundary. <br />Cemex received approval for the Dowe Flats Estates Subdivision <br />Exemption Case SE-03-01 from Boulder County on April 15, 2004 through <br />Resolution 2003-63 and the plat has been recorded with the Boulder <br />County Clerk and Recorder at Reception No. 25577189. The subdivision <br />can not be developed until after mining and reclamation are complete and <br />the two roads shown and labeled on Figure 1 will remain after mining and <br />reclamation as access to the approved subdivision. Therefore, these <br />roads do not need to be part of the financial warranty for reclamation. <br />• Maximum Allowable Acreage of Disturbance at Any One Time Durinq <br />Mining Before Reclamation Must Begin <br />The current permit contains a provision that unreclaimed mining <br />disturbance shall not exceed 95 acres. We have calculated the current <br />unreclaimed mining disturbance at approximately 91 acres. We would like <br />to clarify that the 95-acre disturbance maximum does not include other <br />affected lands, such as the access road, trailers and maintenance shop, <br />stockpiles, etc. <br />It should be noted that Cemex has revegetated approximately 148 acres <br />of previously disturbed land, including mining and stockpile areas (see <br />Figure 2 for a map depicting the reclaimed and unreclaimed land). <br />Cemex is requesting, through this Technical Revision, an increase in the <br />maximum allowable acreage of unreclaimed mine disturbance from 95 <br />acres to 105 acres. The current unreclaimed mine disturbance is shown <br />on Figure 2. <br />• Total Allowed Affected Acres for the Life of the Mine <br />Affected land includes mining and reclamation areas, haul and access <br />roads, the crusher and conveyor areas, trailers and maintenance shop, <br />waste rock and topsoil stockpile areas and the fuel island. For <br />clarification, the 385 acre limitation on mine disturbance is not the same <br />as total affected land. The 385 acres is the actual area to be mined. <br />The total allowed affected land for the life of the mine will be the 385 acre <br />ultimate mine perimeter (inside of which all mining will occur) plus the <br />acreage of all the other categories of affected land mentioned above. <br />Subtracted from this category will be the main access road from State <br />Highway 66 and the road entering the site from County Road 49.
