For additional specific findings concerning this alluvial valley floor please see <br />Section B, XIII. <br />13. The Division hereby approves the post-mining land use of the operation. It was <br />determined that grazing/rangeland and wildlife habitat meets the requirements of <br />Rule 4.16 for the permit area. (2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals are <br />addressed in the following section, Section B. (2.07.6(2)(m)). <br />15. The Division finds the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the <br />destruction or adverse modification of their critical habitats. (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees <br />Branch. As of this time, 2 August, 2004, the operator is current in the payment <br />of reclamation fees required by 30 CFR Chapter VII, subchapter R. <br />(2.07.6(2)(0)). <br />Section B <br />The following findings and specific approvals are required by Rule 4: <br />I. Roads <br />Haul Roads: Rule 4.03.1 <br />There are no haul roads at the Southfield Mine site or loadout. All coal was <br />loaded into highway haulage trucks within the open mine yard which extended to <br />County Road 92. The loadout has been reclaimed and has gone through a <br />Phase I Bond Release. <br />Access Roads: Rule 4.03.2 <br />The mine has one access road to and from the mine refuse disposal area, which <br />extends from County Road 92 to the facility area and to the refuse pile (see Map <br />18 for details). All the permitted roads for the mine site can be found on Map 18 <br />of the permit application. The access road was constructed in 1982 and is <br />maintained in compliance with applicable regulatory requirements. Drainage <br />from the road is captured via a ditch and routed into Sediment Pond #5 through <br />a 30" culvert after passing through the facilities area (see Map 20 for culvert <br />location). <br />The road was originally a ranch road that was expanded for use specifically <br />designed for the 30 ton rear dump truck utilized to haul coal refuse. Maximum <br />design speed is 35 MPH, design width 30 feet and sustained grade 10%. EFCI, <br />Page 16 of 36
