an ore stockpile at the mine at this time; accordingly, all surface drainage from the <br />Whirlwind portal area is routed to the sedimentation pond. Erosion control measures and <br />maintenance have been and will continue to be implemented as needed to maintain the <br />surface area in a stable condition. <br />The financial warranty posted for the site is based on the disturbance that will occur at the <br />end of the mine life when the waste rock area is extended to its maximum size. The <br />existing financial warranty is, therefore, more than adequate to guarantee reclamation of <br />the current disturbed area, which is substantially smaller than the maximum surface <br />footprint. <br />As required under Rule 1.13.7, Energy Fuels will report to the Board through the Annual <br />Report: <br />i) the condition of the mine at the time of cessation; <br />ii) specific measures that have been and will be implemented to comply with <br />reclamation, performance standards and Environmental Protection Plan <br />requirements; and <br />iii) plans for resumption of mining. <br />Contact information for the mine and Nucla office remains the same as was outlined in <br />our September 12, 2008 letter.
